  The draft requires that short message service providers and voice call service providers should use code numbers in accordance with the structure, bit length, purpose and scope of use of the telecommunications network approved by the telecommunications regulatory agency, and must not change the bit length, purpose and scope of use without authorization. , Do not change, conceal, or fraudulently use telecommunications network code numbers, send short messages or voice calls that lack or contain false or fraudulent use of the sender’s telecommunications network code number, and cannot transfer or lease telecommunications network code numbers without authorization.

  The draft for comments pointed out that no organization or individual may send commercial short messages or make commercial calls without the user’s consent or request, or the user expressly refuses. If the user does not explicitly agree, it shall be deemed as a rejection. After the user agrees and clearly refuses to receive, it should stop.

  The draft requires that when short message service providers send port-type commercial short messages, they should ensure that the relevant users have agreed or requested to receive them, and retain the user's consent credentials for at least five months.

  The draft for comments clarifies that if short message service providers send port-type commercial short messages, they should clearly mark the name and contact number of the organization or individual sending the short message through their service in the short message, and provide a convenient and effective way to refuse to receive and Inform the user with the short message, and shall not set obstacles to the user's refusal in any form.

  The draft requires that voice call service providers shall not make platform-type commercial calls, and shall not provide communication resources, platform facilities and other conditions for organizations and individuals that call commercial calls in violation of these regulations.

  The draft for soliciting comments is clear that the Ministry of Industry and Information Technology has organized the establishment of a unified nationwide "decline call" platform to guide relevant organizations or individuals to respect the wishes of users and regulate commercial calls. Basic telecommunications business operators should rely on the "Decline Call" platform to provide the "Decline Call" service, take a convenient and effective way to register users' willingness to receive commercial calls, and provide anti-intrusion services based on the user's wishes and mutual agreement.

  If a mobile communication resale business operator provides the service of "declining calls", the provisions of the preceding paragraph shall be referred to. Operators of basic telecommunications services shall provide operators of mobile communication resale services with the "no call" service to provide necessary assistance.
