Galicia has asked the central government to reform legislative measures to fight the covid-19 pandemic, including establishing "sanitary cordons" or restricting the right to assembly in order to avoid contagion.

This has been requested by the Minister of Health, Jesús Vázquez Almuiña , in a letter sent to the Minister of Health, Salvador Illa, in which he advocates providing "legal security", the Xunta reported in a statement.

The Xunta proposes to make regulatory changes that introduce sufficient measures to prevent the spread of the coronavirus and "avoid having to continually go to the so-called state of alarm", which allows the central government to temporarily restrict the mobility of the population.

"The autonomous communities need legislative tools that go beyond judicial authorizations, and that provide them with legal certainty when establishing measures or restrictions in each of the autonomies," says the councilor.

Thus, it suggests that the new legislation allow the authorities "the possibility of adopting general measures" such as "sanitary cordons, or possible confinement of the population or the option of limiting the right of assembly."

The representative of the Xunta de Galicia, who provides the suggestions with a legal report, indicates that according to some jurists, "if these measures have a general character, they would not be subject to judicial ratification in order to be adopted."

It also underlines that the legislative amendment should "define what would be the state and regional powers" in cases where the situation "affects more than one community", as is the case of the movement of people between autonomous communities.

Likewise, in order to prevent and avoid the spread of the covid-19 pandemic in the coming months and to establish coordination measures, Almuiña proposes a monographic meeting to study "general measures" on the return of students to classrooms.

Avoid normative cataract

On the other hand, the president of the Community of Madrid, Isabel Díaz Ayuso, has requested that the Government of Spain "pilot" the application of the smoking ban if the safety distance or the closure of nightlife cannot be respected, to avoid a "cataract" of regional regulations.

This has been asserted this Saturday, without specifying questions from journalists when the eleven measures agreed yesterday between the Government and the autonomies will come into force in the Community of Madrid. "These measures will have to be applied over the next few days," he indicated.

And he has asked to unify the regulations so as not to drive citizens "crazy", after yesterday the Ministry of Health and the communities unanimously agreed to close nightclubs and bars throughout the national territory, limit the hours of restaurants and ban smoking on the street when the minimum distance of two meters cannot be respected.
