In Tatarstan, the Bugulma city court acquitted Sergei Kukushkin, accused of sexual assault on his young daughter. The case was considered a second time.

Earlier, the city court had already found the 27-year-old man innocent, since it found that “he did not try to satisfy his sexual needs at the expense of his daughter,” which means that there was no corpus delicti in his actions.

The prosecutor's office appealed this decision to the Supreme Court of Tatarstan. After the acquittal was canceled, the process was restarted.

On August 13, the court ruled, finding the man innocent under the article on "Violent acts of a sexual nature against a person under the age of 14" (Article 132 of the Criminal Code of the Russian Federation).

At the same time, Kukushkin was sentenced for deliberate infliction of minor harm to health in the form of eight months of correctional labor with a deduction of 10% from earnings to the state. The court took into account the length of his detention and house arrest and released the man from this punishment. The senior assistant to the prosecutor of Tatarstan Ruslan Galiev told the journalists about it.

We will remind, on October 27 last year, Kukushkin looked after three children while his wife was at work. At about 23:00 he called his wife and said that the youngest daughter was bleeding, the girl was hospitalized with genital trauma. During the investigation, the man did not admit his guilt and claimed that he injured his daughter by accident when he changed her diaper.

On August 12, during the debate, the prosecutor requested 14 years for Kukushkin in a strict regime colony.

The state prosecutor noted that the results of the examination, the testimony of the person involved in the case and his wife prove that the man acted with direct intent, and the injuries that were recorded in the child could not be caused by accident.

At the trial, the prosecutor's office requested that medical documents from the Leninogorsk Central Regional Hospital (CRH) be added to the case on the fact of the victim's admission.

In addition, the state prosecutor filed a petition for the interests of the girl to be represented by an employee of the guardianship and guardianship department of the Bugulma municipal district, and not by her mother. According to the prosecutor, Anna Kukushkina does not care about her daughter's interests. The court rejected both motions.

In turn, Kukushkin's wife told RT that she believes in her husband's innocence and is glad that he will return to his family.

“When I ran home, I asked him not to call an ambulance, because I knew perfectly well that then he would be accused of violence. But Sergei himself called the doctors, ”she said, refuting the information in the media that her husband allegedly did not want to call an ambulance for his daughter.

During the second consideration of the case, the court heard the testimony of witnesses - friends of the Kukushkin family, who were in their apartment that evening.

“Anya called me at about 23:00, said that the youngest daughter was bleeding from the crotch, and asked me to go to her home,” a witness in the case told RT. - The door was opened by Sergei, he spoke with Anya on the phone. I examined the child, there was a small amount of blood on the diaper, the girl was no longer crying. Then Anya arrived, and she and her husband decided to call an ambulance: Sergei called, and Anya spoke to the doctors. "

Earlier, RT had at its disposal the protocol of doctors from the Children's Republican Clinical Hospital, who on October 31 last year treated the injured girl - then she needed surgical assistance. According to the document, the child was diagnosed with an injury to the external genital organs, damage to the vestibule of the vagina - a rupture of the posterior commissure, as well as a hematoma in the area of ​​the right labia majora. In the conclusion, it was noted that the hymen was not broken.

“The wound was sutured, two interrupted sutures were applied,” the document says.

At the request of RT, forensic expert Alexander Aulov analyzed the diagnosis and noted that "by the nature of the injuries, it is impossible to make an unambiguous conclusion about whether they were inflicted on purpose."

According to him, the father could, due to inexperience, touch the child with his finger or press too hard on the skin when changing the diaper. The expert emphasized that, based on this conclusion of the doctors, one can draw only one unequivocal conclusion: there was no penetration, since the hymen was intact.

In November 2019, when the investigation began, the Kukushkin family was put on an interdepartmental record as being in a socially dangerous situation. The office of the republican ombudsman for the rights of the child told RT that they are monitoring the situation and the state of the children - the family is visited by social welfare and guardianship officers.
