• The case: The judge sends the entire Pujol family to the bench for criminal organization
  • The investigation: two decades of commissions of the 'Pujol clan'
  • The facts: Los Pujols: seven years of provisional freedom full of headlines and money without justification

The Sumarroca family has asked the National Court to be exonerated from the Pujol case because it denies having paid commissions to the Catalan clan in exchange for public contracts. Carlos Sumarroca Coixet and his son Carlos Sumarroca Claverol have filed an appeal against the recent order of Judge José de la Mata , in which the magistrate agrees to open an oral trial against the Pujol family, considering it a criminal organization that collected bribes from a large number of group of businessmen, among whom it places the representatives of one of the most relevant business sagas in Catalonia.

According to the Sumarroca recourse, the investigation into the Pujol case , for which Judge De la Mata proposes to put them on the bench, "has started from a generic and unfounded police hypothesis." According to it, "there has been an attempt to construct a presumed crime of money laundering" with "an absolute absence of indications of the existence of an underlying criminal activity that constitutes a preceding crime."

The Sumarroca family admits to having hired the Pujol's eldest son, Jordi Pujol Ferrusola, through their companies, but maintains that the payments correspond to real professional services. And she emphasizes that in no case was it a matter of bribes to obtain public tenders in Catalonia.

The businessmen clarify that it was Carlos Sumarroca Jr. who negotiated the hiring of the services of Pujol Ferrusola to advise them on certain businesses and that, therefore, it makes no sense that Carlos Sumarroca Sr., who did not participate in any of the hiring.

The construction company EMTE

Likewise, this renowned Catalan family refutes the police thesis that the public contracts they received in Catalonia were due, in large part, to Jordi Pujol Soley's historical friendship with Sumarroca Coixet.

They explain that their construction company EMTE "has never occupied the top awarding positions of the Generalitat, neither by number of awards nor by volume". Something that, the Sumarroca points out, "is observed from the data published by the Generalitat and by the Chamber of Contractors."

In fact, "many other companies occupy the first positions in the ranking of companies awarded public works, many years with amounts up to 10 times higher than those awarded to EMTE".

They also indicate that "the Generalitat's awards to EMTE represented less than 5% of the company's global turnover" and add that "EMTE's activity was not based or based on contracting with the Generalitat."

Moreover, they emphasize that "contracting with the Generalitat has not suffered significant variations over the years or with successive changes of government." Given the circumstance that "it had its maximum at the time of the tripartite (PSC, ERC and ICV )".

The relationship with Jordi Pujol Ferrusola

Regarding the contracts signed with Pujol Ferrusola, the Sumarroca family admits that they resorted to him to create a subsidiary of the construction company in Mexico, where the eldest son of the former Catalan regional president had made numerous investments and had multiple contacts, as well as to undertake an operation linked to Radio France .

The payments for both have nothing to do, emphasizes their appeal, with a simulation that covered up the illegal payment in exchange for public contracts of the Catalan Government, for which they deny in turn the existence of a crime of documentary falsification that, together to money laundering, the researchers attribute them.

Therefore, the businessmen request the dismissal of the proceedings in regard to them, since they have proven, in their opinion, the legality of all the operations that, they emphasize, were declared to the Treasury and are recorded in the official accounting of the company.
