China’s National Flag Law and National Emblem Law were reviewed and approved by the 14th and 18th meetings of the Standing Committee of the Seventh National People’s Congress in June 1990 and March 1991 respectively. Ten meetings have made amendments to individual articles.

Zang Tiewei said that with the development of China's politics, economy, and society, the national flag and national emblem are used more and more widely. There are some unsuitable problems encountered in the implementation of the national flag law and national emblem law, and they need to keep pace with the times and be revised and improved.

According to reports, the draft improves the national flag and national emblem standards. Provisions have been added that the national flags of other scales used in special circumstances should be appropriately enlarged or reduced in proportion to the general scale. The scale and proportion of the national flag and flagpoles should be appropriate and suitable for the purpose of use, surrounding buildings and surrounding environment. The draft amendment to the National Emblem Law adds provisions that if a national emblem of a non-universal size is hung, it should be suitable for the purpose of use, the building where it is located, and the surrounding environment.

Increase the occasions for hoisting the national flag and the national emblem. In order to reflect the new changes in the state institutions after the reform of the national supervision system, it is added that the “CPC Central Commission for Discipline Inspection and the National Supervisory Commission” hoist the national flag every day. The national flag is displayed on weekdays. According to the development of practice, regulations have been added for the display of the national flag at places where constitutional oaths are taken, the requirements for the display of the national flag on National Constitution Day and Martyrs’ Memorial Day have been increased, and regulations have been made for the display of the national flag on important festivals and memorial days in residential communities.

The draft amendment to the National Emblem Law clarifies that the supervisory committees at all levels, the people's congress venues of townships, ethnic townships, and towns, the township people's governments to hang the national emblem, and the place where the constitution is sworn should be displayed.

The third is to clarify the regulatory authorities for the national flag and national emblem. The draft adds a provision that the department determined by the State Council will coordinate the management of the national flag and national emblem nationwide, and the local people's governments at all levels will coordinate the management of the national flag and national emblem within their administrative area.
