The Ministry of Human Resources and Emiratisation asserted that the work authorities have the right to obligate any of their employees to work during official holidays, if work conditions so require, provided that workers are compensated with a similar vacation on other days, provided that the worker receives his basic wage for the usual work hours, in addition to To an increase of not less than 50% of this wage.
According to the ministry, the total of official holidays, which workers and employees of private sector establishments and institutions in the state receive, during one year, to 10 days of official vacation with full pay, according to what is stipulated in Article 74 of the Labor Law, as the worker receives one day for each of Eid’s Day The Islamic New Year, the New Year's Day, the Prophet’s birthday, Israa, Al-Maraj, and the National Day, and two days for Eid Al-Fitr, in addition to three days for Eid Al-Adha and Arafat’s pause.
It stated that the only exception to compensation for the day of vacation is any of the occasions mentioned in the law, if this leave coincides with the day of the weekly holiday (Friday), because the Federal Law regarding the regulation of labor relations, and its executive regulations, did not return with them what stipulates compensation for official leave if it coincides with the weekend. He stressed that the Federal Law on Regulating Work Relations states that Friday is the day of the weekly holiday for all employees, with the exception of workers who work with daily wages. According to the Ministry, Chapter Four of Federal Law No. (8) of 1980 regarding the regulation of labor relations stated that if the worker is required to work on a public holiday, he is granted a similar vacation on another day, with an increase of the basic wage for that day by 50%, If a holiday is not granted in lieu of the official holiday, then its basic wage for that day will be increased by 150%. +
