Japan-Korea Conflict over Export Control Go to hearing at WHO July 29, 21:42

The WTO decided to set up a subcommittee to be the first instance of the trial in response to South Korea's appeal against the WTO = World Trade Organization against the Japanese measures that tightened export control of semiconductor raw materials for South Korea. The rivalry between Japan and South Korea will be heard at an international organization.

In July of last year, Japan sought to violate international trade rules in June, regarding measures to tighten export control to South Korea for three items such as semiconductor raw materials. We filed a lawsuit seeking the establishment of a subcommittee.

In response to this, the WTO discussed the response at the meeting last month, but opposed it by arguing that the Japanese side allowed exports that were confirmed to be safe from the viewpoint of security, and thus opposed it. Was sent off and South Korea was calling for the installation again.

The WTO will hold a meeting at the headquarters in Geneva, Switzerland on 29th to discuss it, and if there is a second request for the establishment of a subcommittee, it will allow the establishment unless all members oppose it. We decided to set up a subcommittee based on the regulations.

The WTO has a policy of proceeding with the appointment of a member who will be a judge, and the conflict between Japan and South Korea over export control will be heard at international organizations.

Future WTO procedures

The WTO, which has a subcommittee, will begin the process of selecting a member who will be a judge while listening to the opinions of Japan and South Korea.

At the subcommittee, both Japan and South Korea will submit their opinions and will justify their assertions at the meeting.

Both sides' arguments will be examined by the committee members and a verdict will be issued.

Japan and South Korea are required to take necessary measures according to the content of the report, but if there is any objection, they can lodge a petition to the higher court, which is the second instance.

Again, each claim will be heard and reported.

The report of the Appellate Body is the final decision of the WTO, and both Japan and South Korea must comply with this.

The period from the establishment of the subcommittee to the finalization of the report of the higher committee is generally set at 12 months, but in reality, it often takes longer.

In addition, the Appellate Body is currently in a suspended state because it cannot secure the required number of members, and it is unclear whether the settlement will be smoothly achieved at the WTO.
