This letter was sent to the President of the Republic a few days after the revelation by Liberation and Mediapartof a summary note from the General Inspectorate of the National Police (IGPN), which considered that one of the police officers had practiced a "rear choke" on the delivery man, which was not mentioned by the agents in their first statements.

"Take action against officials"

Cédric Chouviat, a 42-year-old father, felt unwell during this police check on January 3 near the Eiffel Tower, during which he was pinned to the ground with his helmet on his head. Taken in critical condition to hospital, he died on January 5. A first autopsy report had noted in this man asphyxiation with "fracture of the larynx" as well as "a previous cardiovascular state".

In this letter, which AFP was able to consult, Mes William Bourdon, Arié Alimi and Vincent Brengarth, who defend the family of the delivery man, ask the Head of State "to intervene so that the police officers concerned are suspended", a request already made on numerous occasions in the press.

"It is not a question […] of undermining the presumption of innocence but, in a preventive manner, of taking a measure with regard to officials who, in a certain way, went beyond the exercise of their functions being at the origin of the death, ”they explain.

"One of the agents has been transferred and the two others no longer exercise"

Three police officers were indicted for "manslaughter" in early July and placed under judicial supervision. A fourth member of the crew, who filmed the scene of the arrest, was placed under the status of assisted witness.

Of the three placed under examination, "one of the agents was transferred and the two others no longer work on the public highway", explains the Ministry of the Interior, observing that "the justice itself has not planned to 'prohibition to practice for these police officers'.

The lawyers also recall that the family had been received by the Minister of the Interior at the time Christophe Castaner who had announced "a study to evaluate all immobilization techniques". However, "we still have not been aware of the evaluation study", they observe. The Chouviat family would like this death "to be at the origin of an essential public debate on certain police methods", according to the three councils.
