The main staff of the independence movement is concentrated this morning in front of the Superior Court of Justice of Catalonia (TSJC), which is currently judging the members of Junts pel Sí (JxSí) at the Table of Parliament in the stage of Carme Forcadell and the former deputy the CUP Mireia Boya for disobeying the Constitution to allow processing of the laws of the proces .

This case was taken up by the Catalan high court after the Supreme Court decided to remove this piece and send it to the TSJC so as not to include Forcadell's colleagues in the trial at the top of the procés , in which the former president of the Parlament was sentenced to 11 years and 6 months in prison for sedition for his "decisive" role in creating a "parallel legality invalid" from his "privileged position" in the Catalan Chamber.

In the trial, the four independent Forcadell comrades at the table - Anna Simó (ERC), Lluís Corominas (PDeCAT), Ramona Barrufet (PDeCAT) and Lluís Guinó (PDeCAT) - and former CUP deputy Mireia Boya face a tax petition of up to one year and eight months of disqualification and a fine of 30,000 euros for serious disobedience, for allowing, among others, the processing of the referendum and national transitory laws approved in plenary session on September 6 and 7, 2017.

Set for the beginning of November 2019, the trial was suspended for the first time due to problems with the lawyers' schedule and, subsequently, the new date was also canceled - between the end of November and December of last year - after Joan Josep Nuet , who was third secretary of the Bureau for Catalonia Yes we can - when the laws were processed procés , was elected deputy for ERC in the Congress and, therefore, graduated to the Supreme Court (TS).

At the beginning of last March, the TS declared itself competent to judge Nuet, as defended by both the TSJC and the Prosecutor's Office , and against the allegations presented by the accused, who preferred to be tried in Catalonia.

The state of alarm for the coronavirus also forced to suspend for the third time the trial, which had been scheduled for the end of April this year, reports Efe.

The case against the four independence politicians of the Mesa del Parlament and Boya was opened as a result of several complaints from the Prosecutor's Office. Former vice presidents Corominas and Guino, former first secretary Simó and former fourth secretary Barrufet are accused of allowing a series of resolutions in favor of the self-determination referendum to be debated in the House, despite the fact that the Constitutional Court had expressly warned them that they had an obligation to prevent any initiative that would elude their mandates.

After voting for the declaration of independence in the Parliament on October 27, 2017, the members of the JxSí Bureau and Nuet himself declared as investigated before the Supreme Court for rebellion, sedition and embezzlement, for allowing the processing of the law of referendum that provided for 1-O and the national transitory law, which were later suspended by the Constitutional Law.

Former CUP deputy Mireia Boya, for her part, was indicted by the Supreme Court for having presented, as president of her parliamentary group, the proposition of the transitory law, which created an alternative legal framework to Spanish in the event that the other independence gained 1-O.

In addition to the Prosecutor's Office, the private prosecution brought by the State Attorney asks for fines of 30,000 euros and a special disqualification of one year and eight months for Corominas, Guino, Simó and Barrufet. Likewise, the popular prosecution of Vox asks for 12 years in prison, a € 108,000 fine and disqualification for the five accused.

The trial, which will be held in morning and afternoon sessions, begins this morning with the statement of the accused and the first witnesses, who will follow on Wednesday, including members of the PSC and Ciudadanos en la Mesa at the Forcadell stage [ David Pérez and José María Espejo-Saavedra ], the ex-presidents of the Parliament Ernest Benach and Núria de Gispert , lawyers of the House and ex-deputies of the CUP, JxSí and Catalunya Sí que es Pot.

Wednesday afternoon and Friday are reserved for the processing of final reports and conclusions, before the trial is seen for sentencing.
