The Erial case , in which alleged bribes are investigated in exchange for ITV awards and the Valencian Wind Plan, will continue to be investigated in Valencia, while the former president of the Generalitat Valencia and former minister with PP Eduardo Zaplana must continue to appear periodically in court: "It does not prove that he does not live a normal life or that he does not attend public events of all kinds such as restaurants , cafes or gyms ."

This appears from two resolutions, to which Europa Press has had access, issued, the first, by the fifth section of the Valencia Court, which dismisses the appeal to the decision of the judge of the case that the investigation be continued in Valencia; and the second, which comes from the court itself, and dismisses Zaplana's request to suppress or reduce his appearances before the competent body.

Regarding the resolution of the Hearing, Zaplana's defense first demanded from the judge that the procedure be sent to Madrid, considering that the alleged crimes for which the 'former president' is being investigated were committed abroad, outside the judicial party From Valencia. The instructor rejected this argument and now the Audience also dismisses it.

In the new resolution, the Valencian court affirms, on the one hand, that those investigated can only raise a question of jurisdiction within the first three days of the term granted to qualify, being forbidden in the investigation phase.

Likewise, it indicates that none of the facts investigated falls within the catalog of crimes whose jurisdiction is attributed to the National Court. He also recalls that the actions have been carried out "not only in Spain, but in and from Valencia" , regardless of whether to ensure the fruits of the "illicit" actions, "the investigated and the companies would have been validated by they created from other natural and / or legal persons located abroad and will manage bank accounts of tax havens ".

He indicates, regarding the coronavirus: "We are facing a 'new normal' and this implies freedom of movement with the rest of the world. They all work, live with other people, go out on the street, etc., there is no more risk than that any of the citizens would have to go to sign the 'apud act' agreed in an office that is in the middle of the street, without crowds and outdoors. "

In this line, he warns: "Without any limitation to make a daily life and if none of the applicants is subjected to 'house arrest by medical prescription', there is also no problem that they can continue to make the appearances imposed in their day."

Furthermore, he adds: "The circumstances that led to the adoption of the measures have not changed, nor have the indications of the crimes that are presumed to have been committed have disappeared. On the contrary, the more progress is made in the investigation, the more reinforce. "

And it refers to the response of the prosecutor to conclude: "The letter does not specify either nor does it indicate that Eduardo Zaplana's life has ceased to be normal ; it does not indicate that due to a medical prescription he cannot go out on the street or that he does not attend public events of all kinds such as restaurants, cafes or gyms; or being prohibited from meeting with people or limiting their movements; nor, of course, is there any risk of crowds given that weekly appearances are held on public roads, in some external dependencies of the City of the Justice, since it does not even have to be accessed within a closed room. "
