He affirms that it is "a geographical concretion of the measures that in the Plan of Descaling" approved by the central government on April 28 mixes phases I and II and contained in the subsequent Royal Decree-law of June 9 of measures urgent prevention, containment and coordination to face the health crisis caused by Covid-19 .

In its resolution, it states that, according to the articles of the legal text, "it will correspond to the competent organs of the General Administration of the State , of the autonomous communities and of the local entities, within the scope of their respective competences, the functions of surveillance, inspection and control of the correct fulfillment of the measures established in this royal decree-law ".

The judge recalls that the rule is in force as long as the health emergency is not lifted by the Government.

Although it accepts the main mobility measures, it is opposed to prohibiting the meetings of ten or more people, as requested by the Catalan autonomous government, "because this does imply the limitation of the consecrated right" and the "reform of the decree law does not contemplate a measure of such a size . "
