• Maugeri case, Pg Cassation on Formigoni: 'Imposing corrupt barter'

February 22, 2019The doors of the Bollate prison for the former governor of Lombardy Roberto Formigoni, sentenced yesterday by the Cassation to 5 years and 10 months for corruption in the Maugeri-San Raffaele trial, have been opened, with a slight penalty discount for prescription. Formigoni was formed. 

The former president of the Lombardy Region arrived in Bollate accompanied by his lawyer by car. Sitting on the rear seats of a BMW, dressed in a dark coat, Formigoni entered without stopping by the carriage door and then walked towards the entrance. A few minutes later the car with which he arrived left and left.

Formigoni, first interviews with operators: peaceful
Roberto Formigoni appeared "serene" and "calm" to the operators of the Bollate prison with whom he supported a series of talks. Talks including the one with an educator in charge of understanding if, according to the psychological conditions, there are particular measures to be taken to protect his health. From what has transpired, evaluations are underway to establish which cell is suitable for hosting it considering the compatibility with the companions with whom it will have to share a small space.  

Order of imprisonment signed
The deputy Pg of Milan Antonio Lamanna had signed this morning the order of execution of the sentence in the prison of Bollate.

Formigoni's lawyer asks for home detention 
Roberto Formigoni's defense has filed an application to request home detention for the former Lombard governor. The request was presented by the lawyer Mario Brusa, Formigoni's historic defender to the deputy attorney general of Milan Antonio Lamamma. As well as for reasons of age, the lawyer asks that the former president of the Lombardy Region discount his sentence to house arrest because the "sweeper" law, he claims, cannot be applied retroactively.

General Prosecutor ready to give negative opinion
The Milan Public Prosecutor is ready to give negative opinion to the petition for home detention presented by the defense of Roberto Formigoni. In the judicial offices it is noted that the crime of corruption, according to the rules of the "sweepers" law, is "impeding" to alternative measures to prison. The Court of Appeal will decide on the application. 

The other convicts
The Court also dismissed the other appeals of the accused. In particular, the sentence of 7 years and 7 months was confirmed for Costantino Passerino, former manager of Maugeri and that of 3 years and 4 months for the businessman Carlo Farina; Carla Vites' appeal was inadmissible, which had already been acquitted and had appealed against the sentence to have a wider acquittal. Also for Costantino Passerino, the former administrative director of the Maugeri foundation, the prison doors should open again while for the entrepreneur Claudio Farina with the confirmation of the 3 years and 4 months for money laundering the suspension of the execution of the sentence should arrive.

Compensation for the damage to the Lombardy Region
"A very long procedural process ends. The Region was a civil party, we obtained the refund of approximately 6 million in the first and second instance: from a civil point of view the damage has already been compensated" . The lawyer Domenico Aiello, legal representative of the Lombardy Region at the trial for the Maugeri case, told Adnkronos, commenting on the sentence of the Cassation against the former governor Roberto Formigoni.
