In a decision addressed to the new Minister of the Interior Gérald Darmanin, the Defender of the rights, Jacques Toubon, insists on the "urgency" to change the maintenance of the order, in particular by prohibiting the LBD and the wearing of the hood at the police.

The police and their practices are at the heart of Jacques Toubon's final recommendations. A week before handing over, the Defender of Rights has just sent to the new Minister of the Interior, Gérald Darmanin, a list of recommendations on the maintenance of order and in particular calls again for the ban on the launchers of bullets defense.

The so-called "preventive" arrests to be clarified

The famous LBD have replaced flashballs in recent years and have caused the astonishment of certain demonstrators, including Jérome Rodriguez, one of the leaders of the yellow vests.

Another workhorse of Jacques Toubon: the end of the traps. This technique of the police consists of surrounding the demonstrators. The institution also requests clarification of the legal framework for so-called "preventive" arrests. These allow to remove individuals carrying objects and which however represent no danger, like swimming pool goggles or yellow vests.

Towards the end of the hood for the police?

Finally, the Defender of Rights is opposed to wearing a hood for plainclothes police. He deplores the fact that certain procedures have been dismissed because an official could not be identified. Law enforcement reform is one of the thorny issues of the Home Office that Christophe Castaner bequeathed to his successor. A new national plan was to be published last January. The site has since been abandoned. The Defender of Rights therefore reminds Gérald Darmanin of his responsibilities before a social return which promises to be complicated.
