The 70-year-old man was found dead in a forest lot in the areas around Markaryd in early August last year. The man was bound and badly beaten. The 70-year-old had then been missing for ten days.
The prosecutor has prosecuted the men for murder, alternatively gross abuse and gross negligence for the death of another and for the use of means of procurement. One of them is also charged with attempted fraud after trying to withdraw money with the 70-year-old's bank card.
"Caused by another person"After the police went out with an international search, the two suspects, who are both in their 50s and Ukrainian citizens, could be arrested abroad.
The forensic physician has concluded that the circumstances surrounding how the 70-year-old died indicate strongly that the death was caused by another person but no direct cause of death has been determined.
"There is, of course, someone who put this man out in the woods, one of the defendants or one of them and it is the prosecutor's job to prove that everyone is guilty of this," says Torgny Dahlberg, who represents one of the defendants. men.
The prosecutor, however, believes that the crimes took place in consensus.
Refusing to murderThe unclear cause of death, together with the lack of technical evidence linking the two suspects to the crime, will make it difficult for the district court to convict the men for murder, according to defense lawyer Torgny Dahlberg.
The prosecutor says, however, that the evidence situation is good and highlights, among other things, the tape that was found in different places with bearing on the two suspects.
None of the men say they have murdered the 70-year-old, but admit certain circumstances, such as driving or sitting in the 70-year-old's car. The suspects blame each other on how they got over the car.
The suspects remain in custody pending their arrest.
