At the end of November last year, police were alerted to an apartment in Bergsjön, Gothenburg. The man sustained injuries that led the police to suspect that a murder had been committed and therefore initiated a preliminary investigation.

A few days later, three men could be arrested and taken into custody by the police, all suspected of probable cause for the murder of the man. All involved denied crimes. Later, two men, 34 and 32 years old, could be charged with the suspected murder.

"Acting in consensus"

The district court considers it proven that the two men together and, in consensus, caused the knife damage that caused the man's death. But despite the fact that the two men, according to the district court, have shown special ruthlessness and cruelty, they are not convicted of murder or murder.

Instead, the district court makes an assessment on the basis of the indifference intention, which means that the perpetrator must be indifferent to his own act and the effect of this, in this case a stab at the upper part of the back, which the district court does not consider beyond reasonable doubt.

This is what the district court writes in the judgment:

“What the district court stated means that NN and NN should not be convicted of murder. However, by using knives in the way they have done, they have shown special ruthlessness and roughness. Against this background, and when knife violence included a deliberate risk-taking of a serious nature, they must be convicted of gross misconduct and wrongdoing to the death of another, serious crime. "

The two suspects refuse a crime, but they are sentenced by the Gothenburg District Court to six years in prison each for gross abuse and gross negligence until the death of another.
