Dan Gertler, known as "the friend of President Kabila", was accused by the two NGOs of having created a network of front companies and of having continued to acquire, at low prices, mining permits in the Democratic Republic from Congo. In their report entitled Sanctions, Mines of nothing , the two NGOs implicate a bank, Afriland, subsidiary of a Cameroonian bank, which would have accepted deposits of tens of millions of dollars in cash in accounts of relatives of Dan Gertler . Gabriel Bourdon Fattal of PLAAF was Thursday RFI's Africa guest.

Me Eric Moutet is the lawyer for Dan Gertler, but also for the bank in question. He assured that documents had been manipulated and that a complaint had been made to that effect. " A complaint was lodged in France, in Paris, against Global Witness and against the PPLAAF, on the way in which the evidence was gathered in this file, explains Me Moutet to Sonia Rolley of the Africa service of RFI. It was done on behalf of the Afriland bank, since this is where the files were stolen.

We have a lot of evidence that suggests that the stolen files have been tampered with and we have very specific things on this point. We also have documents that demonstrate the very fraudulent manner in which certain testimonies were obtained. So an investigation is going to open and it is absolutely and absolutely necessary, to shed light on the way in which these NGOs work  ”.

Me Moutet assures, moreover, that his client, Dan Gertler, did not seek to circumvent the American sanctions and points out that Global Witness and PPLAAF have not formally accused him of any crime.
