A Gulf employee did not bear the attempt of another person to communicate with his wife by text message by phone, and his insistence on pursuing her despite his blocking and withholding his phone number, so that person was lured and assaulted, and the Public Prosecution Office in Sharjah charged him with eight charges, including kidnapping, robbery, coercion and endangering the life of the victim He is at risk, threatening, insulting and using cruelty, and compelling him to surrender his phone, and the Criminal Court acquitted him of all charges except for stealing the phone and assault, and he sentenced him to a reduced sentence of six months imprisonment with suspended execution due to the circumstances of the incident, and his criminal record is free from any criminal precedent.

In detail, the case started with a notification received by the Sharjah Police stating that an assault had occurred against a Gulf person, then he moved to the location of the communication and asked the victim that he had received a call from the accused asking him why he pursued the women and kept their numbers on his phone, then he requested to meet him and the victim agreed and sent him his location.

He continued, “When the accused came, he first offered to sit in one of the cafes, but he refused and asked him to ride his car. Otherwise, he would stab him. When he got up, he discovered another unknown person in the back seat. The accused took him to a desert area and asked him for his phones. The other, then dragged him out of the car in the desert area.

He added that the accused returned to ask him for his phones, but he refused, and he hit him again with shoes, threatening him with death, cutting his ears and throwing them to the dogs, if he reported it, threatening him with his job, then he took his secret phone number and left him in the Hamriyah suburb, and left with the other person.

The victim indicated that the attack took place near popular homes at about five in the afternoon, and that he had to walk on his feet for about 20 minutes until he met an Asian person and called a friend of his who came and took him. By asking the accused, he denied the assault and admitted that he had taken the victim’s phone because the latter had called his wife’s number more than once, called him and took him to his vehicle, and asked him how he obtained his wife’s number, so the victim told him that he took the phone number from another girl without her knowledge, so he asked him to keep By phone as evidence and not for the purpose of theft, and he got angry when he watched a video of his marriage showing his wife, denying his threat or leaving him in a remote place putting his life in danger, as the victim claimed.

For his part, the defense attorney for the accused, Mohamed Al-Awami Al-Mansoori, argued that the victim’s statements were inconsistent with his friend’s witness testimony in the case, who stated that he saw him preparing to leave, so he offered to accompany him, but he refused, and saw him voluntarily ride the car with the accused.

The defense confirmed that the victim was the one who violated the right of his client, by being exposed to his wife, and that the lawsuit was malicious intended to bargain, demanding the innocence of his principal, and as a precaution to cover him with judicial pardon, the use of clemency, and stopping the execution of the punishment.

The court stated in the merits of the ruling that it was not satisfied with the validity of the kidnapping and threatening accusations due to their inconsistencies, and the victim’s admission that he agreed with the accused to meet him to resolve a dispute between them, as well as their meeting in a public place in broad daylight, which negates the possibilities of extradition and surrender and the allegation of kidnapping, Because he could ask for help or distress.

The court also acquitted the defendant of the charge of endangering the lives of others, because he had left the victim in an area close to the homes, and not as a remote area, as the latter had claimed.

While the court decided to convict him on charges of theft by duress, assault and threat, and decided to imprison him for six months, suspended, taking into account his record free of any precedent and the circumstances that were linked to the incident.
