The Andalusian UGT federation, led by the secretary general, Carmen Castilla , tries to get away from the 40.7 million euro bond imposed by the investigating judge of the alleged plot of false invoices, through which the union looted , allegedly, millionaire funds from the training courses.

EL MUNDO has had access to a document presented by the UGT-A representation before the Investigating Court 9 of Seville, which is finalizing the investigation into the alleged diversion of subsidies from the Andalusian Government during the period of the socialist government. In the brief, the union alleges that its assets are at the disposal of the court and, therefore, it is not necessary for the judge to agree to any "precautionary measure" related to the millionaire bond that could "hinder the ordinary course of its union activity" .

The investigating judge Juan Jesús García Vélez ordered, through a car dated March 13, declaring the opening of an oral trial against 15 people, that the union provide a bond of 40,750,047.74 euros, as "responsible civil subsidiary " to" ensure the civil liability that may arise from the case, with warning of the seizure of their property in sufficient quantity in case of not providing it. All this, in the event that the five members of the former UGT-A leadership prosecuted did not provide the bond of 40.7 million within the indicated period. The five accused are Francisco Fernández Sevilla , former regional secretary of UGT-A, who was forced to resign due to the scandal; Federico Fresneda , treasurer of the union for 15 years between 1998 and 2013; María Charpín , who was secretary of economic management of the union and member of the UGT Confederal guarantees commission; Dolores Sánchez , head of the union's purchasing department; and Enrique Goicoechea Salazar , administrator and CEO of Soralpe, instrumental company ugetista .

In order to try to avoid bail, the UGT-A states in the document presented before the judge that the union is an entity of "special constitutional consideration" , as required by article 7 of the Spanish Constitution, which includes the following: Workers and business associations contribute to the defense and promotion of their own economic and social interests. Its creation and the exercise of its activity are free within the respect of the Constitution and the law. Its internal structure and operation must be democratic ”.

For this reason, and "in relation to the strengthening of civil responsibilities by my client as a subsidiary civilian responsible", the union warns the judge that it has "all its assets" destined to the " defense and promotion of the economic and social interests that they are their own and, in any case, at the disposal of the court, without the need for precautionary measures that could hinder the ordinary course of their union activity, ”states the brief presented by UGT-A.

In the midst of a judicial investigation into this matter, the union sold part of its assets and got rid of its regional headquarters in the center of Seville, on Calle Antonio Salado, a three-storey house with a roof of more than 500 square meters, as reported This newspaper in April 2015. That property is the one registered by the Central Operational Unit (UCO) of the Civil Guard by order of Judge Alaya in December 2013 for eleven hours in search of evidence of the alleged looting of the funds of the unemployed and the alleged plot of false invoices.

UGT-A faces a complicated panorama in the courts and in the administrative headquarters of the Board. The investigation into the alleged plot of the false invoices, which will soon go to trial, is joined by dozens of reinstatement files opened by the Andalusian Government, in which it demands the union to return millions of amounts. This internal investigation in the Board was opened as a result of journalistic revelations about the alleged plot of the union to divert subsidies and finance itself irregularly.

The last reimbursement file was known in October 2019, when the Employment Ministry demanded that the UGT-A return 18 million euros -12.5 corresponding to the amount of the subsidy and another 5.5 of interest- for training courses that he did not justify correctly. The Díaz government also allowed the deadlines to claim, from both the UGT and the CCOO, almost seven million euros that both unions entered for the management of the free time residences and that they should have entered in the accounts of the Board.
