On August 26, 2017, J. and J. returned home after attending a friend's wedding in a farmhouse in the Valencian town of Ribarroja. The party ends, they accepted the proposal of some friends of the groom to bring them to the entrance of Valencia. What none knew was that he would end up in the hospital for being the victims of an alleged hate crime.

On the way, they had "a pleasant conversation" until the co-pilot proposed "go find whores." In an environment that seemed "joking", they replied that they would be "fucking", because they were gay and long-term partner, to add that they just wanted to go home.

At that moment, the storm broke out. The companion, who faces a year and seven months in prison for an alleged hate crime and various fines for assaults, told the driver to stop the car in the middle of the road. "So that I can take them," he collected the indictment from the Public Prosecutor, and turned to start punching them in the head and arms, as stated in the police complaint.

Then he pulled one of them out of the car and slapped him while saying "fucking fagot, cocksucker." Then he undertook it with the other member of the couple. Both managed to flee and called the girlfriend by phone to tell her what had happened and that one of her mobile phones had remained in the car.

And then the attacker, accompanied by the driver of the vehicle (also denounced and whose cause was dismissed), returned to insult them: "Sons of a bitch, why did you call. Fucking fags, I'm going to kill you."

As a consequence of the blows, one of them suffered injuries to the face, neck and jaw that required orthodontics, and the other suffered pain from strong blows, as stated in the medical part of the hospital attached to the case. .

The facts described constitute, in the opinion of the prosecutor Susana Gisbert, a crime against fundamental rights and public liberties, two crimes of injury and two other threats for which a total sentence of one year is claimed and seven months in prison.

Likewise, a fine of 3,600 euros and compensation of 670 euros for injuries, 70 euros for psychological care, 250 euros for orthodontics and 14,000 for moral damage (7,000 to each of the attacked) are requested. The defendant is also claimed the payment of 378.98 euros for the healthcare provided, all with the corresponding legal interests.
