The Supreme Court may review the semi-freedom of prisoners of the process. The head of the Prison Surveillance Court Number 3 of Lérida has sent to the Second Chamber of the High Court the appeal of the Prosecutor against the granting of article 100.2 to the former president of the Parliament Carme Forcadell by the Generalitat.

According to legal sources informing EL MUNDO, the magistrate José Ignacio Félez understands that the jurisdiction to review Forcadell's semi-freedom corresponds to the sentencing court, which is presided over by magistrate Manuel Marchena, when considering 100.2 as a third degree undercover.

The Public Ministry had presented its appeal against the granting of semi-freedom to the former president of the Catalan Chamber before the Provincial Court of Lérida, but the judge, referring to the precedent of the Urdangarin case, has finally decided to refer it to the High Court.

This decision provides the Supreme Court with the opportunity to establish its jurisdiction to review the 100.2 of the 1-O prisoners for the first time. The early semi-liberties granted to Carme Forcadell and the other promoters of the separatist process , who were sentenced by the TS to sentences of up to 13 years in prison for sedition and embezzlement of public funds, were very frowned upon both by the Prosecutor's Office and by himself court that saw his historic sentence defacto five months after being notified.

Until now, successive appeals from the Public Prosecutor's Office against these measures to make the sentence more flexible have fallen to the Provincial Court of Barcelona, ​​pending the overturning or validation of articles 100.2 of the Prison Regulations.
