The latter, who is also the interim leader of the non-majority presidential party (UDPS) in Parliament, went to court against the office of the National Assembly to denounce a procedural violation. An application declared " admissible, but unfounded ", the judgment of the High Court fell like a knife in a small and crowded room. The attorney general had however asked the judges to find the violation of the right to defense of Jean-Marc Kabund by the office of the National Assembly. Without having waited for it, he had decided to convene the plenary session which had therefore ended in dismissing the first vice-president. Not enough to convince the judges ultimately.
But this is not the end, says Me Dieudonné Kondo, Jean-Marc Kabund's lawyer: “ Several avenues exist and we will try to take advantage of them. There is the Court of Cassation which we can seize, but we cannot tell you against whom we can seize it. "
A defense and a failed public prosecutor, we rejoice on the side of the accused party, which remains intransigent in the face of its argument. " What is the principle that has just been affirmed? It is that a vote of the National Assembly escapes the magistrates controls. Kabund has lost and he will never again sit in the office of the National Assembly , ”said the president of the bar, Matadi Wamba.
This decision therefore gives the National Assembly the possibility of calling a new plenary session to elect the successor to Jean-Marc Kabund. Only one application was selected. Presented by the presidential party, of which Kabund is even the interim leader, Patricia Nseya, is waiting to be acclaimed .
