Gansu: "Children's accompanying leave" written into local regulations

The reporter recently learned that the "Regulations on Pension Services for Gansu Province" (hereinafter referred to as the "Regulations") has been the 15th time of the 13th Standing Committee of the Gansu Provincial People's Congress The meeting was approved and will be implemented on July 1 this year.

  The "Regulations" included "children's accompanying leave" in local regulations, causing widespread concern.

Breaking the bottleneck in the development of pension services

  Labor shortage is the bottleneck restricting the development of the pension industry. Statistics show that there are currently more than 40.6 million elderly people with disability and semi-disability in the country, less than 500,000 people are working in various old-age service facilities, and fewer than 20,000 are licensed.

  There are even fewer professionals in Gansu's elderly care services. As of the end of 2019, there were 4.461 million elderly people aged 60 and over in Gansu Province, accounting for 16.9% of the total population, and had entered a stage of rapid population aging.

  On June 16, at the press conference held by the Gansu Provincial Government Information Office, Wen Xinnong, deputy director of the Provincial Civil Affairs Department, said that through the establishment of a sound pension and social worker training, evaluation, selection, use and incentive guarantee policy measures to promote Solve problems such as difficulty in recruiting, poor use, and inability to retain senior care services.

  To this end, the "Regulations" requires that the human and social departments of governments at and above the county level, together with the civil affairs and education departments, establish and improve mechanisms for the cultivation, use, evaluation, and incentives of senior care service personnel, and regulate the employment of senior care services according to law. The training fee subsidy and vocational skill appraisal subsidy for pension service workers shall be implemented in accordance with relevant state regulations. Encourage places where conditions permit to establish a subsidy system for old-age care jobs.

  In order to expand the employment of pension services, the "Regulations" also stipulates that the ordinary college graduates have signed a formal labor contract for more than 5 years at the provincial pension institution, and have served for more than one year. The student loan is funded over the years, and the funds will be allocated from the retention of the welfare fund at the same level; the government at or above the county level should develop public welfare positions engaged in old-age care services in public-benefit old-age care service institutions and communities to attract people with employment difficulties to take care of old-age care. Services; support the development of volunteer service organizations serving the elderly, and establish incentive mechanisms for volunteer services.

  At the same time, colleges and universities, especially vocational colleges (including technical colleges), are encouraged to set up majors or courses related to elderly care services, and to set up health service and management, TCM health care, TCM rehabilitation and other majors in ordinary colleges and universities, and implement subsidy policies in accordance with regulations. Promote the construction of practical training bases for vocational colleges (including technical colleges) for the elderly, and support social forces to establish training institutions for the elderly. Professional doctors, nurses, rehabilitative doctors and other professional and technical personnel engaged in old-age service should implement the same qualifications and registration assessment system as medical institutions, and enjoy the same level of professional title and continuing education as similar professional technicians in medical institutions. Treatment, and gradually increase salary and benefits. Encourage professional and technical personnel supporting medical institutions to flow to pension service institutions.

  Relevant people said that with the integration and development of elderly care services and medical, health, cultural and other industries, the service format has continued to innovate, from homes, communities to institutions, from public to private, from pocket services, basic services to high-end services. The construction of the supply pattern will add a large number of jobs to the society and solve the problems of labor shortage and talent shortage.

 The implementation still needs to strengthen the rigid constraints

  According to incomplete statistics, since 2016, 18 provinces and cities across the country have made provisions for "child care leave" through local legislation or administrative regulations. However, at the implementation level, there is still an embarrassment to implement it. Some employees feel that some enterprises cannot guarantee even annual leave and marriage leave. This policy is even more difficult to implement.

  Zhang Hongjun and Mai Jiwen, members of the Lanzhou Municipal People's Political Consultative Conference, have submitted proposals to recommend the development of family pension policies such as paid paternity leave for sick parents.

  After the introduction of the "Regulations", Zhang Hongjun said that the implementation of "children's escort leave" also needs to strengthen rigid constraints and "embed" children's escort leave into the inclusive vacation system.

  Fan Hongbin, director of the Central and Western Asia Research Institute of the Lanzhou Academy of Social Sciences, who has conducted key research projects such as "Research on the Construction of the Urban and Rural Pension Security System in Lanzhou" and "Research on the Impact of Changes in the Population Structure of Lanzhou on Social and Economic Development", said that "For how long to rest" and "how to protect" and other issues, the government should formulate specific rules on the duration of accompanying children based on only children or non-only children, clarify the corresponding number of days of care, and do not deduct wages, allowances, subsidies and bonuses during accompanying children. If the employer does not pay wages and benefits during this period, the Human Resources and Social Security Bureau or the relevant department shall order payment within a time limit. Once the application for the leave is rejected by the employer, the applicant’s social and labor department may be involved in coordination according to law. The employer in a serious situation shall be included in the illegal “blacklist”. Administrative law enforcement departments, including labor and personnel departments, should do a good job of supervision. When the rights and interests of laborers are violated, complaints should be promptly reported to the relevant departments.

  Fan Hongbin said that he should also consider factors such as the impact of the increase in holidays on the labor costs of enterprises and introduce corresponding supporting measures. For example, certain tax subsidies are given to enterprises that strictly implement this system, and a supporting system that is integrated and compatible with the whole society is established.
