For several months, an application of the gendarmerie has been controversial. The military can use since the end of February a new mobile application allowing them to take note of very personal data during their interventions.

Called GendNotes, this tool for taking notes on secure tablets or smartphones intended to replace the policeman's notebook. Authorized by decree of the Prime Minister on February 20 after advice from the National Data Protection Commission (CNIL), it has just been attacked by four LGBT associations.

The latter filed Friday an appeal before the Council of State, accusing the digital tool of allowing the "filing of homosexuals". Article 2 of the decree, the most criticized by the defenders of public freedoms, allows the gendarmes to inform in a free field of personal data, in particular on life or sexual orientation, but only "in case of absolute necessity "

"The situation is left to the free discretion of the gendarmes," notes in a press release the Mousse association, which has filed the appeal alongside Stop Homophobia, Families-LGBT and Adheos.

Already a remedy

The applicants fear that this information would be "transmitted to all the gendarmes inside or outside the unit of origin, as well as to the prefect, sub-prefect and mayor". And that these data can end in the file of the processing of criminal records and be "kept for 20 years and accessible by any police officer and gendarmerie".

“The history of the criminalization of homosexuality is concomitant with that of the filing of homosexuals. It is therefore essential to have the GendNotes decree annulled, because behind the specter of filing hovers that of the repression and discrimination of LGBT people ", considers Etienne Deshoulières, the lawyer for the four associations.

This app has already been appealed to the Council of State on June 2 by the Internet Society France, which defends the rights of Internet users, and HES (Homosexualities and socialisms) which defends those of homosexuals.
