The Guardasigilli Alfonso Bonafede said this, responding to the question time in the Senate and announcing the "imminent issue" of a circular "which balances the relationship between face-to-face work and remote work of the administrative staff and aims in general to guarantee, as far as possible, the regular celebration of hearings, in safe conditions, starting from July 1, 2020 ".

The minister recalled that from 22 May "the national control room for the management of judicial activity during the phase 2 of the emergency from Covid-19 was established to ensure monitoring of the recovery and to allow targeted and effective interventions". Also, he added, "the huge investments" allocated with the relaunch dl, "are allowing to install all the necessary safety devices according to the indications of the health authority, because guaranteeing a service means ensuring that it does not involve risks for the health of citizens and professionals ".

Bonafede recalled that "the adoption of the organizational measures put in place so far has been an obligatory choice to protect the health of professionals and citizens, in light of an alarming epidemiological picture: I am well aware of the alleged lack of homogeneity of the interventions, but on the point - he explained - I must underline that the entrusting of the organizational choices to the individual managers was decided to calibrate the interventions on the specific needs of the individual judicial and territorial realities ".

Justice Reform
"For this reform, I hope that the discussion will be as broad as possible and that, despite the legitimate differences, will lead to the approval of a regulatory framework capable of remedying all the distortions involving the judiciary". "We are at the point of no return: a clear and profound intervention can no longer be postponed, to protect citizens and the vast majority of the judiciary that looks with disdain at that type of dynamics".

Two weeks ago, said Bonafede, "I represented in the Chamber that the reform will have to provide for a new electoral system to eliminate the degeneration of current accountancy, mechanisms to ensure, with a view to eliminating careerism, that only the merit is the center of the criteria with which we proceed in the appointments and career advancement, a separation between politics and the judiciary, with the provision of rules that definitively close the so-called 'revolving doors' and rigid forecasts, which, more generally, clearly demarcate the line between the performance of the functions of the magistrate with respect to all the tasks that the same could be called to perform outside the role of the judiciary ". These, concluded the minister, "are the guidelines on which I am available for discussion, in the knowledge that only through a serious debate can indifferent solutions be found to restore citizens' trust in justice and in the work of the judiciary".

Equal opportunities
The reform of the CSM "currently in the pipeline, based on the absolute enhancement of the preparation and competence of candidates who aspire to senior positions, must clearly guarantee equal access to the roles in question, as well as within the Board itself". "A hypothesis under consideration tends to borrow the system dictated by the law for the election of the members of the European Parliament according to which up to three preferences can be expressed: in choosing the plurality of preferences expressed, these must concern candidates of different sex ".

The goal, continued Bonafede," is to find a regulatory mechanism that allows, without slipping into the logic of reserved places, the effective participation of all citizens, without gender difference, in fundamental roles for Italian justice. The professionalism of women in the judiciary must be valued regardless of the places assigned to them, precisely to avoid the risk of claiming a concession, rather than a real right ".

At this moment the State must demonstrate that it is close to citizens and businesses, especially the small and medium-sized ones that suffered the most from the period of closure and can become easy prey for criminal organizations.
