• Justice: First trial against the 'patriotic police': Podemos asks two leaders for 10 years in prison for a maneuver against the Pujol
  • Accused. The judge sits the old police cupola on the bench for the Pujol pendrive against fiscal criteria

The statement of the first two policemen tried for a maneuver attributed to the patriotic police has started with the accused saying that they were not going to respond to the attorney for the Pujol family or that of Podemos, a formation that has made the State sewers a of their electoral flags. The police have indeed responded to the Prosecutor's Office, although in this case the Public Ministry requests acquittal.

The accused are the former deputy operational director (DAO) of the National Police Eugenio Pino and a chief inspector under his command, Bonifacio Díez . They allegedly introduced incriminating material obtained illegally into the investigation around Jordi Pujol Ferrusola . Both have denied it.

Pino has recognized a story that largely coincides with that of the accusations, but with divergences in responsibilities. He received a pendrive that came from the investigation to the Metodo 3 detective agency , but because it was given to him by the then head of Internal Affairs Marcelino Martín-Blas , with whom he is at odds today.

"Marcelino went to Barcelona and one day he appeared to me with an electronic storage device. He told me: 'Here, what these have given me'. I understood that he was referring to the detectives. He gave it to me, I tried to open it and I couldn't. I said 'give it to the CNI' - because there was a general who collaborated with Method 3- and 'give it to the Judicial Police'. And automatically I have not heard from the device again. "

Pino: "Voices hit me"

The former number 2 of the Police with the popular Jorge Fernández Díaz has added that all this happened in 2012 or 2013, while the investigation indicates that the delivery of the material to the Udef occurred some time later. "Did you receive a flash drive in March 2015?" Asked the prosecutor, "No, no, no," Pino insisted, repeatedly clicking his tongue.

The former DAO has recalled his appearance before the judge of the National Court José de la Mata when the magistrate tried to clarify where the pendrive came from , which the judge ended up removing from the case so that it did not contaminate everything.

"The State attorney beats me and the prosecutor beats me. I was about to get up and go to Plaza de Castilla to denounce coercion," said Pino to the surprise of the president of Section 23, who asked him to repeat these words.

Key witnesses

For his part, the chief inspector has denied having been the person who in 2015 brought the flash drive from the DAO headquarters to the Udef at Pino's direction. He has acknowledged that he sometimes ran errands for his superior, including delivering documents, but not that one in particular.

"No, never. The DAO never gives me that express order," he answered the question of whether Pino told him to give the USB key to the head of the Udef. "If he had given me the order, he would have complied with it. He would have put me in the first greeting time and would have complied without any doubt. I have never had any perception that he could give me an illegal order."

After the two defendants, witnesses have begun to appear, although the most relevant will arrive between Wednesday and Thursday. The list includes the imprisoned commissioner José Manuel Villarejo and the aforementioned Martín Blas. Also to the head of the Udef, Manuel Vázquez , whose testimony has been postponed due to complications in the videoconference and who will be key for the court to trace the origin of the flash drive .

The accusations

Before his statement, the court had rejected the defendants' request that Podemos be forced to withdraw two of the three charges, those of crimes of procedural fraud and false testimony.

The reason was that the injured party, Jordi Pujol Ferrusola, only accused him of discovering and revealing secrets and that Podemos cannot go beyond the victim. The political formation asks for a total of 10 and a half years in prison for each Police, a figure that the Pujol representation leaves at two and a half.
