• Municipal.Colau appoints a new head of the Urban Guard

The Mayor of Barcelona, ​​Ada Colau, is not exempt from the audit of the Justice for her decisions at the head of the Consistory of the Catalan capital. The Barcelona Prosecutor's Office has decided to open informative proceedings based on a complaint filed by the Independent Trade Union and Official Central (CSIF), against Ada Colau and the current head of the Barcelona Urban Guard, Pedro Velázquez, for an alleged crime of prevarication committed a few months ago when the police post was appointed to head the municipal body. Based on these proceedings, the Public Ministry is collecting information to verify if this appointment could be criminal, as the union maintains, so it has started this investigation process to determine if there was any possible irregularity.

On December 17, Ada Colau appointed Pedro Velázquez, who was the mayor of the body, to the new head of the Urbana de Barcelona, ​​by means of a mayoral decree. However, CSIF, in its complaint, maintains that "this appointment is totally contrary to law" since the City Council did not follow "the principles of objectivity, merit, capacity and equal opportunities" in appointing this new police command and, presumably, what it did "unilaterally and arbitrarily, and without any legal basis."

The complaint highlights that in the Barcelona Urban Guard there are 8 senior mayors who could replace the then head of the body, Evelio Vázquez, who was relieved by the mayor. "In the present case, it is obvious that there was no appointment in accordance with the constitutional principles" of merit and equal opportunities, the union points out since the same day that the previous head of the Urbana was dismissed, the new one was appointed without mediate "a procedure of convocation among the highest ranking officials to make the appointment of the chief under the principles established by law of objectivity, merit, ability and equality."

In addition, the union points out that coinciding with this promotion, which were embodied by Mayor's decrees, there was also the promotion of the current head of Urbana "from the category of Mayor to that of Mayor Mayor." For this reason, CSIF remarks that this appointment of Chief of the Urban Guard existed "without having any seniority in the category of Mayor," despite the fact that it is necessary to be the maximum person in charge of the municipal police force.

The union recalls that there is a ruling by an Administrative Litigation Court in Barcelona detailing that municipalities have the obligation to process the procedure for the provision of a new command through the Local Police law "having to be careful with its compliance " CSIF filed an appeal for reversal against the Mayor's decree appointing the new Chief of the Urban Guard, although for the moment they regret that they have received no response.

The complaint to the Prosecutor's Office indicates that the new head of the Urbana would also commit a crime by having accepted a public position "fraudulently", without complying with the requirements established in the regulations and allegedly knowing "the illegality of the procedure." At the same time, they emphasize that Colau signed the Mayor's agreements with the cessation of the previous person in charge and the promotion and appointment of the new one, supposedly knowing that it was an "arbitrary" decision.

The document that the Prosecutor's Office investigates adds that last March the call and the bases of the free designation for access to the post of chief of the Urban Guard were published in the Municipal Gazette. The union believes that "firstly, the post of head of the Barcelona Urban Guard is granted by nominal decree with the exercise of it, without any reason whatsoever for the urgency, and, subsequently, an attempt is made to give it legal form with a covering of legality to an arbitrary and unjustified prior decision in order to launder the procedure. "
