The Public Prosecutor's Office of the National Court has presented its final accusation against the Major of the Mossos d'Esquadra Josep Lluís Trapero on Monday. The Public Ministry has withdrawn its accusation of rebellion and has replaced it with a crime of sedition, something obliged by the Supreme Court ruling on the process but which hardly reduces the penalties: instead of 11 years in prison, he requests 10.

More relevant than that change has been the addition. The Public Prosecutor's Office, now headed by former Justice Minister Dolores Delgado, offers as an alternative a sentence only for disobedience, which does not entail jail. In this case, the proposed penalty is one year and eight months of disqualification, as well as a fine of 60,000 euros. Disqualification would mean expelling Trapero from the body of Mossos d'Esquadra.

The modification announced by the lieutenant prosecutor of the National Court, Miguel Ángel Carballo , extends to the two political leaders of the Mossos during 1-O who were also accused of rebellion: the former director of the Mossos Pere Soler and the former Secretary General of the Interior César Puig . In all three cases, the request for imprisonment for sedition remains high because they are considered "main perpetrators" of the crime, given their authority. This implies that the minimum sentence was based on the 10 years requested.

The fourth accused, the mayor of the Mossos Teresa Laplana , was already accused of sedition from the beginning, with a four-year petition that remains. In your case, the change is limited to adding the option of disobedience for six months of disqualification.

The trial was interrupted in March by the coronavirus health crisis. It has resumed in the National Court, but with Trapero and the rest of the accused following him from Barcelona by videoconference.

Although the main request remains a harsh sentence for sedition, the inclusion of an alternative legal qualification leads to softer sentences, as it sends the message that for the Prosecutor's Office it is an acceptable legal option. The decision to add the option of disobedience was agreed last March between the attorney general, Dolores Delgado and the chief prosecutor of the National Court, Jesús Alonso . That wink towards Trapero contrasts with the actions of the Office of the Supreme Prosecutor in the time of María José Segarra at the Office of the Attorney General, when a conviction for rebellion was requested without raising a softer option.

The crime of disobedience is the one that the Supreme one imposed on the three accused of the process : Santiago Vila, Meritxell Borrás and Carles Mundó. All three were sentenced to one year and eight months of disqualification and to pay a fine of 60,000 euros.

The Prosecutor's Office is the only accusation in this case, where there are no popular accusations. Defenses have also communicated this Tuesday their final request after the trial, which obviously does not change: four acquittals.
