Two videos of 27 and 46 seconds recorded by José Ángel Prenda from the co-pilot seat of a car at 07:23 on May 1, 2016 constitute the main evidence of charges against four of the five members of La Manada accused of sexual abuse of a young woman in Pozoblanco ( Córdoba ). Videos are the key to the sentence -very extensive, as this newspaper has learned-, which will be announced on June 4.

A large part of the trial held last November in Córdoba revolved around whether the researchers obtained these images lawfully or not, whether they should be admitted as evidence or not. Judge Luis Javier Santos , head of Prison number 1 , then decided that he would rule on the validity of the recordings in the sentence. His decision on the matter, therefore, will be decisive in the verdict.

The content: groping and kissing

The images show the interior of a vehicle. In the front are former civil guard Antonio Manuel Guerrero driving and José Ángel Prenda as co-pilot. In the back seats are three people: a girl who seems unconscious in the center; Jesús Escudero sitting on his right, and former military officer Alfonso Jesús Cabezuelo on his left. The provincial police officer who analyzed the videos stated at the trial that everyone at some point abused the girl. José Ángel Prenda "reaches into the neckline and touches her chest." Antonio Manuel Guerrero "makes a touch with the right hand on the victim's chest, over the clothing." Jesus "kisses her, runs his tongue over her face and touches her on the chest above the monkey." Alfonso Jesús Cabezuelo "grabs her by the neck and kisses her on the mouth."

The state in which the young woman, 21 years old at the time, appears in the images was described by the agent as "inert": "She does not have any type of reaction, it is not known if she is asleep or unconscious, there is no body movement of the victim".

In the videos you can hear laughter from the four Sevillians and a phrase pronounced by Antonio Manuel Guerrero: «This is Pozoblanco and this is La Manada ».

THE 'WHATSAPP': 22 minutes

It is the time it took for young people to share video with two WhatsApp groups : La Manada (7 members) and Peligro (21). Messages like these were written in these chats: "What skill, driving with one hand and with the other taking a tit in the back", "my goodness, what did you put on the chick, burundanga ?, how good", "is she dead or what? "," I would be in a coma "," and what have they done to the girl? Have they thrown her into the river? "," is another case, Marta del Castillo, boy hahaha.

Start of the case: mobiles

«On July 7, 2016, José Ángel Prenda, Alfonso Jesús Cabezuelo, Antonio Manuel Guerrero, Jesús Escudero and Ángel Boza (the latter is the only one of the five not involved in the Pozoblanco case) are arrested in Pamplona accused of rape. Young people voluntarily hand over their mobiles. In September 2016, in the register of the same, the Navarra Provincial Police found these two videos, recorded from the Guerrero terminal two months before the events of San Fermín . It was unknown where the images had been taken and who the girl might be.

Starting from the fact that in one of the videos the word "Pozoblanco" is heard, the agents begin to pull the thread and analyze the images uploaded to Facebook of the Torrecampo festivities , a town 20 kilometers from Pozoblanco that was celebrating nightly night. images were taken. This is how they reach a Facebook profile with a young woman similar to the girl in the car and who also had a mole on her chest as the alleged victim. A local agent contacts her through the local Pozoblanco police and reveals the existence of the videos. I knew it, I knew it, I knew it. No one believed me, "she replied according to the agent's statement.

The next step is the displacement of two provincial police officers to Córdoba to meet the young woman in a hotel. They take samples of her hair to look for traces of drugs and collect the jumpsuit she was wearing that night, which was washed and torn.

The alleged victim then denounces the facts.

Legality of videos: the key

During the trial, the defense asked for the videos to be annulled based on the fact that the accused handed over their mobile phones for the Pamplona case, but not for the investigation of other facts and that the Navarra Provincial Police "lacked judicial authorization" to obtain those images. He argued that a prospective investigation was carried out in search of another crime, a practice rejected by the General Council of the Judiciary , and that the investigating court sent two agents to Córdoba to provoke the complaint of the alleged victim. The local police officer who investigated the case defended the legality of obtaining the evidence at trial. He assured that they arrived at the recordings when, by court order, they compared the video of the violation of San Fermín with the rest of the images stored on mobile phones. That upon discovering the videos of Pozoblanco and communicating it to the judge, the latter entrusted them with the identification of the possible victim. And that once located, the judge gave them instructions "verbally" to move to Córdoba and collect the hair samples.

THE VICTIM. "Bitch"

He declared behind closed doors and protected by a screen. According to his statement, the agent who revealed the existence of the videos told him that he did not report because he did not remember anything. Who woke up naked in the back of a vehicle with Alfonso Jesús Cabezuelo in the passenger seat. That he asked her to do fellatio and when she refused, he threw her out of the car and called her a "whore".

According to the account of the events of the Prosecutor's Office , the young woman, originally from Pozoblanco, coincided with the accused in a booth at the Torrecampo festivities, where she had a drink with former military officer Alfonso Jesús Cabezuelo. At the closing of the premises, around 07:15, Cabezuelo offered to take her to Pozoblanco, a route in which Prenda, as he himself stated in the trial, recorded the videos with Guerrero's cell phone. Already in Pozoblanco, three of the accused got out of the car and Cabezuelo continued with the girl. It was when the young woman would have woken up.

THE WITNESSES: «General amnesia»

Were the words of the judge before the forgetfulness of the friends of the accused, members of the chats where the videos were shared. "I don't remember," "a long time ago," "I don't remember," they declared. An acquaintance of the alleged victim, who coincided with her at the Torrecampo parties, assured that the next day the young woman called him "very scared" and that he told her that "she had been raped". Later, he advised her on WhatsApp to report and she replied that she was ashamed because "she did not know who it was".

The penalties: SIX YEARS

The Prosecutor's Office asks for the four accused two years in prison for sexual abuse and four years for crimes against privacy for the recording and dissemination of the videos. The private prosecution increases its request to six years and nine months: two years and six months for sexual abuse and four years and three months for a crime against privacy. The defense of La Manada , exercised by the same lawyer who represented them in Pamplona, Agustín Martínez Becerra , requests acquittal based on the illegality of the video. And, if accepted, considering that there is no crime of sexual abuse, requests two years in prison for Prenda for a crime of maltreatment in competition with another against privacy; a fine of one month for Escudero, and six months in prison for Cabezuelo and Guerrero for a crime against moral integrity in competition with another of harassment.

Defendants will know the verdict first

The four members of 'La Manada' accused in the Pozoblanco case will be the first to know the verdict. According to his lawyer, Agustín Martínez Becerra, it is expected that before 11.00 next Thursday they will receive a copy of the verdict in the prisons where they are serving their sentences.
