The judge of the 8-M Carmen Rodríguez-Medel has received in the last hours a formal request for the accusation of Fernando Simón. The lawyer Víctor Valladares, representing the Association against the Management of Coronavirus, has asked the instructor this Thursday to charge the director of the Center for Coordination of Health Alerts (CCAES) for the crimes of disobedience and denial of aid. In addition, it has presented an extension of the complaint against the Government delegate in Madrid, José Manuel Franco, to be investigated for a crime against public liberties established in article 514 of the Penal Code.

In the petition sent to the court, to which EL MUNDO has had access, the popular prosecution has asked that Simón be cited as investigated for "a flagrant abandonment of his duties as well as obligations" that have endangered public health , and physical integrity of all Spaniards and residents in Spain ". Specifically, the lawyer explains that among the functions of the body headed by Fernando Simón, dependent on the Ministry of Health, is "developing and maintaining a rapid system of detection, communication, evaluation and response to health alerts."

Specifically, the complainant highlights the "contradictions" of the doctor regarding "the mandatory use of masks, the need for serological tests, the lack of truthful information on the number of deaths from coronavirus, the denial at first of a real danger in Spain of the existence of the virus, affirming that there would have been isolated events, and never of local contagion, when it already had reports from the World Health Organization (WHO) and the European Union. " Likewise, the lawyer Víctor Valladares emphasizes that Simón "encouraged the attendance of the feminist march of 8M, despite the fact that the coronavirus in Spain was out of control".

In the letter sent to the court, the lawyer analyzes the attestation of the Civil Guard incorporated into the proceedings where the meetings that were held at the headquarters of the Ministry of Health with the representatives of the Evangelical Church three days after the celebration of the Women's Day march. In those meetings, both Simon and the Health Minister Salvador Illa conveyed to the religious that the congress they had called "could not be held in any way." However, the doctor "encouraged" to go to 8-M.

The accusation emphasizes that "due to public health reasons, in various meetings with organizers of massive events on the dates under investigation, Simón declared the impossibility of holding it, but on the other hand, it was not only that it allowed, but also encouraged to go to mass demonstrations, such as the feminist 8M, thereby contravening its functions and obligations contained in the Ministerial Order of 2004 ", which establishes the Coordination System for Alerts and Emergencies of Health and Consumption.

The complainants highlight the double standard of the doctor when it comes to allowing or prohibiting mass demonstrations and meetings in the days prior to the decree of the state of alarm. Valladares highlights "the eminently intentional attitude of Simón with the prohibition of the celebration of some demonstrations absolutely curtailed by reports from the WHO, the EU and the CCAES itself and the Ministry of Health with the permissiveness of the celebration of others, even encouraging their presence as it happened at the feminist demonstration in Madrid on March 8.
