The Federation Council suggested that the new version of the Code of Administrative Offenses be liable for entrepreneurs, officials and legal entities for breaking silence at night. Such an initiative was made by a committee of the Federation Council on constitutional law, RIA Novosti reported. They noted that we are talking about cafes and restaurants, as well as about construction sites.

“To establish in the new Code of Administrative Offenses of Russia administrative responsibility for citizens, officials, individual entrepreneurs and legal entities for violating the peace and quiet of citizens at night,” the document says.

Law enforcement officials are invited to provide the right to draw up reports on such administrative offenses.

The current draft of the Code of Administrative Offenses contains only an article on the responsibility of individuals for breaking silence at night, notes the first deputy chairman of the committee of the Federation Council Irina Rukavishnikova. However, she added that cafes and restaurants located near residential buildings and construction work could also violate citizens' rights to rest at night.

Earlier, the Ministry of Justice of Russia proposed in the new Code of Administrative Offenses to introduce punishments for those who do not prevent the production of noise in the period from 23:00 to 07:00.

It is assumed that such a measure will make it possible to prosecute the owners of dogs barking at night, as well as those who do not turn off the car's alarm system.

Olga Kovitidi, member of the Federation Council Committee on Constitutional Legislation and State Building, explained to RT that responsibility for individuals and legal entities to violate silence at night is a guarantee of the protection of civil rights and freedoms of Russians. According to her, that is why the proposed rule should be included in the new Code of Administrative Offenses.

“Therefore, I am firmly convinced that we simply need such a norm. Our committee monitors the general sociological situation, the mood in society. The initiative, first of all, comes from the people themselves. Today, there is a public request for the implementation of the constitutional right of man and citizen to silence. In this case, I think it is extremely important, ”Olga Kovitidi emphasized.

In an interview with RT, First Deputy Chairman of the Public Control Commission of the Public Chamber of Russia, lawyer Artyom Kiryanov, noted that he supported the initiative of the Federation Council committee on constitutional law.

According to Kiryanov, despite the fact that in most constituent entities of the Russian Federation norms of compliance with the silence regime have been adopted, law enforcement agencies are faced with the fact that they do not have an adequate legal basis for applying the necessary sanctions to violators.

In addition, the expert emphasized the relevance of the initiative in the context of the situation with coronavirus.

“In this regard, of course, the legislation on silence is spurred by the current situation with self-isolation of people, when people spend most of their time at home. Of course, this discussion has escalated, ”he said.

In addition, a member of the public chamber suggested that lawmakers might go down the road to tougher sanctions in the future. For example, they may limit the ability to make noise not only at night, but at certain times during the day.

“That is, those watches, for example, which already today declare free from noise, for example, a partnership of homeowners - watches, for example, children’s afternoon break. It is also quite possible to describe it in federal legislation, ”Kiryanov noted.

Note that this is not the only initiative designed to protect the peace of citizens.

So, on May 5, Russia entered into force a law banning the sale of alcohol in institutions located in residential buildings. The corresponding decree was signed by Russian President Vladimir Putin on April 24.

The changes affected premises with an area of ​​less than 20 square meters. m. At the same time, the authorities of the regions were given the right to increase the minimum possible area of ​​such establishments, as well as to impose a complete ban on the sale of alcohol in residential buildings.

The authors of the bill noted that residents of houses where such establishments are located very often complain about noise and have a negative attitude towards them.
