The decision has been made at the request of the Minister of Health, Enrique Ruiz Escudero, in a Governing Council held in extraordinary session this afternoon. Thus, the Autonomous Executive understands that the way in which decisions have been made from the Ministry of Health on the denial of the change to phase 1 could "violate several essential principles and norms of the legal system . " This, they add, "justifies the presentation of the contentious-administrative appeal."

Reports

Going into detail and in relation to the first request to change to phase 1, presented two weeks ago after a tense internal discussion in the Madrid government itself, they maintain that they are not "aware" that there is any report that "motivates the rejection to the progression request. " For this reason, they understand that the lack of such documentation "could represent a serious defect".

Regarding the second attempt, registered eight days later, they argue that the report of the General Directorate of Public Health sent to them by the Ministry of Health after they announced the possibility of resorting to the courts "is after the communication of the decision", specifically three hours. "In addition, the reasons given by that report to motivate the denial are not directly related to the indicators of the so-called Plan for the Transition to a New Normality," they specify in the Madrid government.
