Veteran Vladimir Pavlov did not receive a lump sum payment on Victory Day in the amount of 75 thousand rubles, appointed by decree of the President of the Russian Federation. The bureaucracy and different understanding of the Pension Fund and relatives of the veteran of Russian laws became a hindrance to the transfer of funds. The fact is that Vladimir Pavlov from 1941 to 1945 did not really serve in the army. Directly during the war, he worked as a truck driver at a defense plant.

Meanwhile, the Samara veteran in 1949-1951 "fought with the nationalist underground in Ukraine." In other words, he beat Bandera. And this gives Pavlov the official status of a veteran.

In the federal law dated 12.01.1995 N 5-ФЗ "On Veterans" there are several groups of people who are officially considered veterans of the Great Patriotic War. This is directly the front-line soldiers, and intelligence officers who performed special tasks behind enemy lines or in the territories of other states, and partisans, and NKVD workers who fought against saboteurs ... 

All groups are listed in paragraph 1 of Art. 2 of the Law "On Veterans". This list also mentions the military personnel "who took part in military operations to eliminate the nationalist underground in the territories of Ukraine, Belarus, Lithuania, Latvia and Estonia from January 1, 1944 to December 31, 1951".

The presidential decree No. 100 “On the lump-sum payment to certain categories of citizens in connection with the 75th anniversary of the Victory in the Great Patriotic War” says: “Make a lump-sum payment to the following categories of citizens in April-May 2020: invalids of the Great Patriotic War, veterans of the Great Patriotic War from the number of persons specified in subparagraphs 1-3 of paragraph 1 of Article 2 of the Federal Law of January 12, 1995 N 5-ФЗ "On Veterans".

Based on the text of the decree, Vladimir Pavlov has the right to veteran payments by May 9. By the way, in previous years, according to relatives, he always received holiday allowances and congratulations from the authorities.

How the FIU interprets a presidential decree

“On April 8, a social service worker brought Vladimir Pavlov another pension. A veteran receives from the state, taking into account all the premiums, about 50 thousand rubles. But the promised additional 75 thousand rubles did not appear. When asked by relatives about the missing holiday payment, the social worker answered that one should go to the Pension Fund for clarification, ”said Anton Pogorelov, lawyer for RT. The lawyer agreed to help the veteran’s relatives free of charge.

According to the lawyer, a 90-year-old man cannot walk after a hip fracture. Earlier, Vladimir Sergeyevich had an operation on ligaments, because of which he can only speak in a quiet whisper.

“It is not surprising that the interests of the veteran are represented by his family. Relatives did not even begin to tell Pavlov about the situation with the payment so as not to upset the old man, ”says Pogorelov.

Phone calls to the Pension Fund of the Russian Federation in the Samara region, according to the lawyer, did not give anything. The veteran's family answered approximately the same thing in a conversation: the money was supposedly put only to those who participated in the events of 1941–45.

On May 12, the FIU sent the attorney a four-page response to the request (RT has it at his disposal). The department’s position has not changed, but it has become clearer why, according to the Pension Fund, Vladimir Pavlov is not entitled to payments.

“The wording“ from among persons ”used in Decree No. 100 means that the circle indicated in them includes citizens belonging to participants and invalids of the Great Patriotic War from the categories named in subparagraph 1 of paragraph 1 of Article 2 of the Law“ On Veterans ”, which were directly related to the events that took place during the Great Patriotic War, by which, in the framework of the implementation of Decree No. 100, we mean the period from 1941 to 1945. Thus, Decree No. 100 ... cannot apply to persons not named in this decree, ”reads the official written response of the FIU to lawyer Pogorelov.

“According to the documents at the disposal of the FIU bodies, Pavlov worked during the Great Patriotic War from 03/25/1944 to 05/09/1945. It is also not possible to make payments in the amount of 50 thousand rubles ... due to the lack of a document confirming the status of “rear worker”, the PFR said in a letter.

Go to the Supreme Court

Meanwhile, there is a certificate from the military commissariat of the Samara region stating that "Vladimir Pavlov is a member of the Great Patriotic War and took part as a soldier who served in the army." The veteran is also issued a certificate of participation in the war.

    But, according to employees of the FIU, all this does not matter, they continue to interpret the phrase “from among individuals” in their own way.

    The regional prosecutor’s office has already become interested in the story of unpaid funds to Vladimir Pavlov. The department "will thoroughly understand the situation, if necessary, by means of prosecutorial measures, it will ensure the restoration of the rights of a veteran."

    Meanwhile, the story received an unexpected continuation. About the position of the veteran in his Twitter wrote the district deputy of Samara Andrei Sedogin.

      He commented on his tweet from the account of the Pension Fund for the Samara Region: “We hope that the Supreme Court will finally give clarifications on this issue.” Meanwhile, Sedogin recalled that a 90-year-old lying veteran without a voice “hasn’t as much time as we do.”
