None of the passengers were attached, including the two children who did not have a suitable seat. The driver was driving without insurance or up-to-date technical control. Placed under judicial supervision, he no longer had the right to drive since then.

The judge who tried him in direct appearance, Tuesday, raised a legal problem to decide the acquittal of the accused for the offense of driving without a license, as raised by lawyer Isabelle Mimran. The Nîmes public prosecutor's office immediately appealed this decision.
