"The ball is in the government's court: Either it accepts the version we proposed in the Senate and we will vote for the text, or it is not and we will vote against it," he told Sud Radio. .

The measure voted by the senators (majority LR) provided that "no one can see his criminal responsibility engaged" for contaminations by the coronavirus during the state of health emergency, except in case of deliberate intention, recklessness or negligence. The text was then amended by the Legislative Committee at the Assembly, in particular by LREM to take into account "the state of scientific knowledge at the time of the facts". A "red line" according to Damien Abad, because that would involve "a system of generalized amnesty".

In addition, beyond elected officials in the field, this amendment "is more aimed at ministers and directors of central administration", he said. "What we simply wanted to do in the Senate is that the mayors, school directors, business leaders", not be brought to justice for having applied the rules, for his part explained the boss of senators LR Bruno Retailleau, "ulcerated" by the LREM amendment which "exonerates ministers and the government". Bruno Retailleau repeated on BFMTV / RMC that the president LR of the Senate Gérard Larcher "will immediately seize the constitutional council" because of "article 6 which creates an information system with health data".

A "month by month" vote

Damien Abad also rejected this system intended to trace infected people because "there is no longer anonymity, volunteering and data is kept for a year" which "seems to us totally disproportionate". He also called for parliament to vote "month by month" on the extension of the state of emergency. While the Prime Minister must present the details of the deconfinement in the afternoon, Damien Abad wanted "a real territorial differentiation" and that "in the green departments, we reopen more things", in particular so that "shops and cafes under certain conditions "can" initiate this movement ".
