In the future, there will be the following six changes to the traffic violation handling procedures:
First, traffic offenders can handle off-site traffic offenses across different provinces. In the past, motor vehicle drivers could only deal with off-site traffic violations at the place where the traffic violation occurred or where the motor vehicle was registered. From May 1, in Hunan, Guangxi, Sichuan, Guizhou, Yunnan, and nationwide at the end of June, motor vehicle drivers who have no objection to the facts of traffic violations may choose to deal with the place where the violation occurred, or The public security traffic control department of any place other than the place where the incident occurred is accepted for treatment, and the administrative penalty is executed according to the penalty standard of the place where the incident occurred.
The second is to further clarify the traffic violation information notification requirements. In order to improve the notification rate of traffic violations and the timeliness of handling, from May 1st, the public security traffic control department will complete the information review and entry within five days after the traffic technology monitoring equipment records the violations, and provide enquiries to the society on the day after the entry. The public security traffic control department will also notify the owner or manager of the motor vehicle via mobile phone text messages, mobile Internet applications, etc. When the traffic police found out that the traffic violations of the motor vehicle had not been dealt with within the time limit during law enforcement, they would also inform the parties on the spot.
The third is to increase electronic delivery and announcement delivery procedures. On the basis of the original direct service, the public security and traffic control department will serve the legal documents through postal service, electronic service, announcement service, etc., to ensure that the legal documents are delivered in accordance with the law, in a timely, standardized and effective manner. Among them, electronic delivery includes mobile Internet applications, e-mail, mobile communications and other methods.
Fourth, the procedures for handling traffic violations have been further improved. For off-site traffic violations, the parties have not taken the initiative to be notified by the public security traffic control department. After the public security traffic control department strictly performed the notification procedure according to the law and notified the content of the punishment and the rights enjoyed by the party, the party has neither filed an objection nor handled it in time The public security and traffic control department may make administrative punishment decisions directly in accordance with the law as appropriate.
Fifth, implement an information transfer system. If the traffic violation information recorded by the traffic technology monitoring equipment can determine the actual driver, the public security traffic control department may change the traffic violation record from the name of the motor vehicle to the name of the actual driver. This will further promote the implementation of illegal reform measures to facilitate the handling of rental car traffic and benefit the majority of leased drivers. It is expected to save hundreds of millions of yuan in operating costs for rental companies every year.
Sixth, standardize the reporting system for traffic violations. From May 1st, the public security traffic control department can establish a traffic violation reporting system based on local conditions to further enhance road traffic social co-governance capabilities and public participation levels. If the photo or video of illegal activities provided by the unit or individual is verified, the public security traffic control department may use it as evidence of punishment. In order to maintain a good social fashion, the public security traffic control department will ensure that the masses report traffic violations and achieve good social effects by strictly regulating the scope and procedures of the masses' reports and cracking down on malicious reports in accordance with the law.
