25 April 2020The president of the Sicilian region, Nello Musumeci, opposes the return of the mafia bosses to Sicily. "There are reasons of security, public order and common sense to say no to the return of some dangerous prisoners to the places where they lived and where they committed serious crimes. This is why certain decisions leave you stunned. And the disbelief that some magistrates feel, from always on the front line, it is the same that ordinary people are feeling ". "If you really need to assign mafia characters of thick house arrest in order to decongest prisons in this period of epidemic, then consider different solutions absolutely," says Musumeci, referring to the release from Bonura, Iannazzo, Sansone and, lastly, Zagaria.

The President of the Region addressed the Prime Minister, Giuseppe Conte and the Interior Ministers, Luciana Lamorgese, and Justice, Alfonso Bonafede, "to evaluate alternative measures to release from prison". For Musumeci "Sicily is a land that in addition to having paid a very high tribute to mafia power, in terms of broken lives and denied development, can absolutely not run the risk that the return home of some bosses, albeit with all the restrictions and controls, rekindle who knows what power dynamics within
criminal organizations . "

Uspp: "State shock boss release from prison"
"The slap to the victims of crimes is equal to the dismay of those who investigated, arrested, tried and, not least kept in custody as done by the valiant men of the Gom of the Prison Police, who represents a social danger: it is by interpreting their dismay that we believe this and the other releases, which occurred with the 'excuse' of the risk of contagion, a shock to the credibility of the State because it is absurd that public structures such as penitentiaries cannot have environments and health facilities up to par to preserve health especially in the case of more dangerous prisoners and in any case also of the staff who work there ". This is underlined by the Union of Prison Police Unions (USPP) after the granting of house arrest to Pasquale Zagaria, brother of the Casalesi clan boss Michele Zagaria. "If there is a place of detention and a custodial method that minimizes the risk of contagion - adds the union in a note - these are the sections and the 41 bis regime where the restricted subjects are in almost total isolation and in single cells, and, in cases like Sassari, not even contiguous with each other and totally separate from other pavilions ".

Antigone: "On Zagaria case unacceptable fuss"
"An instrumental and unacceptable fuss is also being created in the case concerning the granting of home detention for health reasons in Pasquale Zagaria. The supervisory judiciary must be able to carry out its work independently by applying the law". Patrizio Gonnella, president of Antigone declares it, recalling that "the law, starting from our Constitution, provides that the right to health is guaranteed to every individual (article 32) and that the penalty cannot consist in treatments contrary to the sense of humanity (article 27). Provisions that apply to everyone, without exception. "

The president of Antigone also returns to underline that "there is no risk of mass release of mafia bosses, so much so that the granting of a home detention order was still denied yesterday (which is still a penalty and it is not a return to freedom) to Nitto Santapaola: what magistrates do is to evaluate, case by case, and on the advice of doctors, the compatibility between the state of health of a prisoner and the possibility that the pathologies will be treated at better within institutions. And only where this is not possible, alternative measures are put in place. "
