More than 10 million French people, or around one in two employees, are affected by partial unemployment due to the coronavirus pandemic. With this system, employees receive 70% of their gross salary. But many workers wonder whether it is possible to work for another company during partial unemployment. The lawyer Roland Perez explains why this is possible, and under what conditions.

It is possible, provided you do not work for a competitor 

It is quite possible to work for another company. The first situation concerns those who are partially unemployed and who wish to come to the aid of sectors of activity which lack manpower. During a period of partial unemployment, the employment contract is suspended: it is therefore sufficient to inform the company, while specifying the name of the new employer "and the estimated duration of work". That's what the law says.

But beware, the employee who goes to work during his partial unemployment for another employer must not work for a competitor, or on his own account concurrently with his employer. And on the salary side, the employee will combine his partial unemployment benefit with the salary paid for his temporary job.

"Exchange" of employees is authorized, subject to agreement 

The other solution - this time more united - is the "exchange" of employees between companies. In this case, it is the employer who offers to make his employees available to another company which has increased activity due, precisely, to the economic consequences of the pandemic. This loan of employees can only be made with the agreement of the employees in question, who will keep their usual employment contracts and receive their full salary, which will be reimbursed to the nearest euro by the company which will employ them temporarily .
