  • Justice: The State Bar questions the Interior sanctions against those who breach the confinement

The Ministry of the Interior has sent the government delegations guidelines to quantify the fines for those who violate the confinement. It is, according to the Ministry's criteria, a serious offense, to which according to the Citizen Security Law there are penalties of 601 to 30,000 euros . In the Interior proposal, this maximum is not reached and indicates the highest amount of 10,400 euros .

The minimum penalty of 601 euros would apply to the most basic and also the most frequent cases: citizens who take a walk without justification, something that Interior calls "unauthorized displacement " and without "concurrent circumstances" that aggravate it. If the hunted is someone who had previously been detected in breach of the movement ban, this "persistence" doubles the fine to 1,200 euros.

Cases are also foreseen in which the accused does not behave correctly with the agents, to different degrees. The " contempt " for the authority leads to penalties of 2,000 euros. If they are intimidated - as long as it does not become a crime - the penalty is 3,000. The maximum amount foreseen of 10,400 euros is for when the citizen resists violence or threatens the agents, again if the intensity is not so high as to jump from the administrative sanction to the possible crime.

There is only one other assumption in which the 10,400 euros are reached: the " organization or participation in common activities, celebrations, celebrations, etc. ", when the agents consider that there has been a "high" risk to health, taking into account circumstances such as the number of people or proximity.

Unauthorized movements that are also made in company are estimated at 1,500 euros. The same amount is expected for those who are intercepted trying to move to their second residence.

Something frequent, according to the experience of the agents, is that the citizen tries to avoid their identification . In these cases, the proposed sanction will be 700 euros. But it could go up to 1,500 if "deliberate action to avoid or hinder identification is detected."

The State Security Forces have already filed more than half a million complaints proposing sanctions for failing to comply with article 36.6 of the Citizen Security Law. However, there is a good chance that virtually all of them will be revoked. A report by the state's attorney general, Consuelo Castro , warned that the disobedience attributed to those accused of failing to comply with the state of alarm decree can only be applied to those who resist the agents. Not those who have simply been caught and do not resist. The thesis of the Legal Profession is that it should be sanctioned according to the General Law of Public Health , not by means of the Citizen Security Law .

Despite the reports, the ministry led by Fernando Grande-Marlaska maintains that the correct route is the Citizen Security Law and this is confirmed by the communication sent to government delegations on Tuesday. The document specifies that those who voluntarily pay the penalty within 15 days will have a 50% discount . Those who do it later, but before the end of the procedure, will have a 20% discount. That yes, to pay and to obtain the reduction supposes to resign to challenge the sanction.
