The data shows that from January to March 2020, procuratorial agencies across the country approved and decided to arrest 132,914 people of various crimes, a year-on-year decrease of 41.8%. 37,966 people were arrested without approval or decision, a year-on-year decrease of 39.6%, and the rate of non-arrest was 22.2%, an increase of 0.6 percentage points year-on-year.

The main case handling data of the national procuratorate from January to March 2020 are as follows:

1. Main data of criminal prosecution

(1) Review the arrest and review the prosecution. From January to March 2020, procuratorial agencies nationwide approved and decided to arrest 132,914 people of various crimes, a year-on-year decrease of 41.8%. 37,966 people were arrested without approval or decision, a year-on-year decrease of 39.6%, and the rate of non-arrest was 22.2%, an increase of 0.6 percentage points year-on-year.

For various crimes, a total of 275,450 people were prosecuted, down 25.7% year-on-year; 34,982 people were not prosecuted, up 12.2% year-on-year, and the non-prosecution rate was 11.3%, up 3.5 percentage points year-on-year. Among them, 236,183 persons were tried with the leniency system of pleading guilty and punishment, which accounted for 76.1% of the total number of cases examined and prosecuted in the same period.

While the total number of criminal cases fell year-on-year, the number of crimes committed using telecommunications networks increased year-on-year, and 18,820 people were prosecuted for crimes committed using telecommunication networks, a year-on-year increase of 32.8%. Among the fraud crimes, the use of telecommunications network means is the most prominent, with a total of 11,414 people, a year-on-year increase of 41.6%, accounting for 60.7% of the total prosecution of telecommunications network crimes, an increase of 3.8 percentage points year-on-year.

(2) Handling crime cases that impede the prevention and control of the new coronary pneumonia epidemic. From January to March 2020, the national procuratorate approved and decided to arrest 2966 people for crimes that impede the prevention and control of the new coronary pneumonia epidemic, accounting for 88.6% of the total number of trials, which is 10.8 percentage points higher than the overall criminal offense.

During this period, procuratorial organs concluded 2205 cases of crimes against the prevention and control of the new coronary pneumonia epidemic, which accounted for 76.4% of the cases to be handled, which was 28.4 percentage points higher than the overall criminal crimes. Among them, it was decided to prosecute 2,130 people, accounting for 96.6% of the total number of trials, which is 7.9 percentage points higher than the overall criminal offense.

In the same period, the number of cases in which the procuratorial organs intervened in the investigation of crimes that impeded the prevention and control of the new pneumonia epidemic accounted for 82.8% of the total number of such crimes accepted, which was 79.6 percentage points higher than the overall criminal crimes.

Judging from the crimes involved in the prevention and control of the new crown pneumonia epidemic, a total of 97 crimes were involved. The crimes of fraud and obstruction of official duties were the main ones. 1,845 people were arrested and 580 were arrested, accounting for the total number of crimes that prevented the new crown pneumonia epidemic prevention and control. More than 60%; 1175 people and 714 people were examined and prosecuted, accounting for more than 50% of the total. (3) Criminal execution prosecutions. From January to March 2020, procuratorial organs nationwide proposed to correct 5053 people for improper commutation, parole, and temporary execution outside prison, a year-on-year decrease of 33.5%; 4,832 people have been corrected during the same period, accounting for 95.6% of the number submitted. 1880 cases of correction of criminal law enforcement activities were proposed, a decrease of 66.9% year-on-year; 1646 cases were corrected during the same period, accounting for 87.6% of the number submitted. 2,882 people were corrected for illegal activities outside the prison, down by 47.8% year-on-year; 2181 people were corrected during the same period, accounting for 81.3% of the proposed number. 1264 cases were corrected for improper performance of property punishments, a year-on-year decrease of 57.3%; 940 cases were corrected during the same period, accounting for 74.4% of the number submitted. A total of 5,653 persons were filed for the review of the necessity of detention, a year-on-year decrease of 67.4%; 4,871 persons proposed to change coercive measures or release suggestions, a year-on-year decrease of 68.4%; and 3,714 persons were adopted by the relevant authorities during the same period, accounting for 76.3% of the number proposed.

(4) Handling cases of judicial officers' duty crimes. From January to March 2020, procuratorial organs across the country filed a total of 90 criminal offenses related to judicial staff, an increase of 136.8% year-on-year, of which five were at the county level or above.

Second, the main case data of civil prosecution

(1) Supervision of civil effective judgments, rulings and mediation documents. From January to March 2020, procuratorial organs nationwide handled 11,423 cases, a year-on-year decrease of 30.5%. 768 protests were filed, a decrease of 2% year-on-year. The court concluded 332 cases over the same period. After the retrial, there were a total of 259 judgements, mediations, retrials, reconciliations, and withdrawals, accounting for 78% of the total number of trials. 1,149 retrial procuratorial recommendations were submitted, an increase of 20.9% year-on-year. The court adopted 392 over the same period, accounting for 34.1% of the number of retrial procuratorial recommendations.

(2) Supervision of civil trial activities. From January to March 2020, procuratorial organs across the country accepted 2,698 cases, a year-on-year increase of 31.9%. During the same period, 1,882 cases were concluded, and 1,570 prosecution suggestions were submitted, an increase of 21.4% year-on-year, accounting for 83.4% of the number of cases concluded. The court adopted 961 cases over the same period, accounting for 61.2% of the number of proposals.

(3) Supervision of civil execution activities. From January to March 2020, procuratorial organs across the country handled a total of 3,531 cases, down 6% year-on-year. During the same period, 2,752 cases were concluded, and 1973 prosecution suggestions were submitted, down 11.5% year-on-year, accounting for 71.7% of the number of cases concluded. During the same period, the court adopted 1344 cases, accounting for 68.1% of the number of proposals.

(4) Supervision of civil false litigation. From January to March 2020, procuratorial organs nationwide filed 179 cases of false lawsuits against civil effective judgments and mediations, a year-on-year increase of 28.1%; and 61 cases of false lawsuits involved in prosecution proposals for civil trial activities, a year-on-year increase of 64.9% ; 95 false lawsuits were involved in the prosecution recommendations for the supervision of civil execution activities, an increase of 137.5% year-on-year.

3. The main case data of administrative prosecution

(1) Supervision of administratively effective judgments, rulings, and mediation letters. From January to March 2020, procuratorial organs across the country accepted a total of 2,519 cases, up 1.4% year-on-year. There were 21 protests filed, a year-on-year decrease of 19.2%. The court concluded 14 cases over the same period. After the retrial, the verdict, mediation, retrial, reconciliation and dismissal totaled 11 cases, accounting for 78.6% of the total number of trials. Four retrial procuratorial suggestions were proposed, up 100% year-on-year, and the court ruled that one case should be retrial.

(2) Supervision of administrative trial activities. From January to March 2020, procuratorial organs nationwide accepted 388 cases, a year-on-year increase of 356.5%. During the same period, 357 cases were concluded, and 254 prosecution suggestions were submitted, up 568.4% year-on-year, accounting for 71.2% of the total number of cases concluded. The court adopted 167 cases over the same period, accounting for 65.8% of the number of recommendations.

(3) Supervision of administrative execution activities. From January to March 2020, procuratorial organs nationwide handled 2,475 cases, a year-on-year increase of 292.9%. During the same period, 1,249 cases were concluded, and 838 prosecution suggestions were submitted, an increase of 112.2% year-on-year, accounting for 67.1% of the number of cases concluded. The court adopted 611 cases over the same period, accounting for 72.9% of the number of recommendations.

Fourth, the main case data of public interest litigation prosecution

(1) Status of acceptance and filing. From January to March 2020, procuratorial organs across the country handled a total of 19,459 clues, a year-on-year decrease of 40.9%. 16,173 cases were filed, a year-on-year decrease of 34.7%, accounting for 83.1% of the total number of applications. Among them, civil cases were filed in 2013, an increase of 60% year-on-year, and administrative cases were filed in 14,160 cases, a year-on-year decrease of 39.7%.

(2) The pre-litigation procedures. From January to March 2020, procuratorial organs across the country conducted a total of 11,762 pre-litigation procedures, a year-on-year decrease of 23.5%, including 1,452 pre-litigation procedures for civil welfare, an increase of 114.8% year-on-year, accounting for 12.3%; 10,10 pre-litigation procedures for administrative public welfare, year-on-year A decrease of 29.9%, accounting for 87.7%.

From the perspective of the pre-litigation proceedings, 6,595 cases in the field of ecological environment and resource protection accounted for the highest proportion, accounting for 56.1%; followed by 1,892 cases in the field of food and drug safety, accounting for 16.1%; and 1,035 cases of state-owned property protection, accounting for 8.8% ; 89 state-owned land use right transfer areas, accounting for 0.8%; 2151 other areas, accounting for 18.3%.

(3) The status of litigation and judgment. From January to March 2020, procuratorial organs across the country filed a total of 568 public interest litigations, which was flat year-on-year and accounted for 3.5% of the number of cases filed. Among them, 547 civil public interest litigation, an increase of 1.7% year-on-year, accounting for 96.3% of the number of filings; 21 administrative public interest litigation, a decrease of 30% year-on-year, accounting for 3.7% of the filing. The court made 310 first-instance judgments; 302 judgments were supported, accounting for 97.4% of the judgment cases, including 284 civil public interest litigation and 18 administrative public interest litigation.

(4) Effect of handling cases. From January to March 2020, procuratorial organs across the country passed a public interest litigation inspection to recover, supervise the restoration and cleanup of 87,000 acres of woodlands, wetlands, grasslands, and waters; supervise the treatment of domestic garbage and solid wastes of 179,000 tons; 228 enterprises in the category; compensation for environmental damages of 5.669 million yuan, management and recovery costs 22.449 million yuan; urged to recover 260 million yuan of land use right transfer fees; urged investigation and recovery of 3347.1 kilograms of counterfeit and inferior foods in sales and circulation, fake drugs and 2.6 kg of smuggled drugs.

V. Main case handling data for minors' prosecution

(1) Review the arrest. From January to March 2020, the national procuratorial organs approved a total of 8,668 arrests for juvenile delinquency and crimes against minors, and 2,920 detainees were not arrested. Among them, 3,987 people were arrested for juvenile criminal suspects, and 2003 people were not arrested, with a non-arrest rate of 33.4%, 11.2 percentage points higher than the overall criminal non-arrest rate.

(2) Review the prosecution. From January to March 2020, the procuratorial organs nationwide decided to prosecute 12880 people and commit crimes against minors, but not to prosecute 2712 people. Among them, juvenile criminal suspects decided to prosecute 6,285 people, not to prosecute 2,362 people, the non-prosecution rate is 27.3%, 16 percentage points higher than the overall criminal prosecution rate.

During the same period, the national prosecution authorities decided to prosecute 4,151 people for sexual assault against minors, an increase of 2.2% year-on-year.

(3) The development of relevant special systems. From January to March 2020, procuratorial organs across the country took the initiative to conduct 1,208 social surveys, down 50.4% year-on-year; entrusted judicial administrative agencies and social organizations to conduct 536 social surveys, down 55.4% year-on-year; and carried out 85 judicial aids involving minors , A year-on-year decrease of 16.7%; 290 lectures on the rule of law for minors, a decrease of 90.6% year-on-year, and 22 visits to the rule of law education base, a year-on-year decrease of 95.1%; support for prosecution of guardianship cases for individuals and units (7 Pieces).

From January to March 2020, procuratorial organs across the country accepted a total of 148,556 complaints, complaints, complaints and other petitions, down 30.9% year-on-year; accepted 278 criminal compensation applications, down 25.5% year-on-year. (1) The work of the special fight against evil. From January to March 2020, procuratorial organs across the country accepted and reviewed 4319 criminals and arrested 3,640 people; approved and decided to arrest 3,640 people; accepted and prosecuted 18,575 criminals and decided to prosecute 13,811.

(2) Serve the work situation of the three major battles. From January to March 2020, procuratorial organs across the country arrested 4,234 people and prosecuted 8,207 people for crimes against financial security; arrested 416 people and prosecuted 1,463 people for crimes involving "routine loans", "campus loans" and "collecting private loans by illegal means" .

281 persons were arrested and 835 persons were prosecuted for crimes involving poverty alleviation funds and other work affecting poverty alleviation. Among them, 9 crimes arrested and 87 prosecuted. Judicial assistance was provided to 437 poverty alleviation objects, and a relief fund of 5.255 million yuan was issued.

2,133 people were arrested and 7,790 people were prosecuted for crimes against the protection of environmental resources. From January to March 2020, the Procurator-General of the National Procuratorial Organ and the Deputy Procurator-General entrusted by the Procurator-General participated in 864 people's court meetings. Among them, there were 688 person-times in county districts; 159 person-times in city branches; and 17 person-times in provincial hospitals.

The Prosecutor General attended 405 person-times, accounting for 46.9% of the total attendance; the Deputy Attorney General entrusted by the Prosecutor General attended the 459 person-times, accounting for 53.1% of the total attendance.
