The Government of Pedro Sánchez has begun the procedures to appeal to the Constitutional Court the decree by which the Andalusian Executive has modified up to 21 autonomous regulations with a simplifying aim, eliminating procedures and thus paving the way for private initiative.

As the Cadena Ser has advanced this morning, the Council of Ministers will give the green light to the beginning of the procedures prior to the presentation of this appeal against the so-called 'Simplification of Regulations Decree' for affecting powers that are of the State, precisely in some of the most controversial issues of the reform, which has to do with the reorganization of the radioelectric space in Andalusia and also with the simplification of procedures for carrying out works on buildings with some type of heritage protection.

The announced appeal of the Central Executive is also preceded by the intense dust generated by the regulatory reform in the audiovisual world, because with its decree the Andalusian Government grants the municipalities the possibility of putting their radio stations to tender, which opens the door for companies in the sector to participate in the business of municipal chains and could significantly alter the frequency map in the autonomous community, tightly controlled so far by the central government, which is the one that decides how many frequencies can go on the market throughout the country .

In addition, both the PSOE and Adelante Andalucía also announced that they will appeal the decree of the Board because it was brought to its approval by the Permanent Deputation of Parliament, without waiting for the resumption of ordinary sessions in the autonomous Chamber. Both parties also demanded its processing in the form of a law, although the government justified the rush in the need that, when the economy can be reactivated, the decree is already underway to give more facilities to private initiative.

In addition to opening up to the privatization of local television management, the legal reform lifts, for example, the vetoes on golf courses, increases the freedom of business hours and relaxes the requirements for some tourist activities, in addition to modifying it lowers the requirements in terms of environmental impact in various industrial activities.

The Andalusian Government has rejected, however, that all this regulatory simplification involves a relaxation of controls in the urban or environmental aspect. And he emphasizes that it is only a matter of reducing bureaucracy without assuming the risks derived from the elimination of guarantees. The Executive also assured at the time that the decree was inspired by the way of operating of other autonomous communities and responded to the recommendations of the European Union.

The Pedro Sánchez Government's announcement comes at a particularly tense political moment in the relations of the central administration with the autonomous communities due to the friction generated by the state of alarm and the shortage of sanitary material to face the crisis derived from the pandemic by Covid 19.
