03 April 2020The epidemic risk is "concrete and current" in prisons and "therefore the decision to take alternative measures must be encouraged" to "ease the pressure": "never as in this period should it be remembered that in our system prison is the extreme ratio "and only those who are dangerous or have committed 'red code' offenses must remain. This was written by the Pg of the Cassation Giovanni Salvi in ​​a note, to all the Pg of the Courts of Appeal, which "acts as a basis for common work".

According to Salvi, "it is therefore necessary to encourage the decision of alternative measures suitable to lighten the pressure from unnecessary presences in prison: this is limited to crimes that leave the predictive perimeter of danger and with the further necessary exception linked to the offenses by code red'". The risk of contagion from Coronavirus, adds Salvi, "leaves no time to develop personalized investigations, and can in many cases represent 'the objectification' of the situation of inapplicability of custody in prison for the protection of public health, based on the same dictated criteria for the population in order to counter the spread of the virus ".
