A coalition formed by the governments of 19 US states, all of them Democrats, filed a lawsuit against the White House on Tuesday for their decision to divert $ 3.8 billion allocated by Congress to Defense to build the border wall with Mexico.

The states claim that the unilateral action of the Administration directed by President Donald Trump is a violation of the powers of Congress and that the fact that this money stops being invested in Defense will damage the economic interests of its states.

"Congress has explicitly and repeatedly rejected that taxpayers finance Trump's inefficient and expensive border wall. We go to court again to remind Donald Trump that even the president is not above the law." California State Attorney Xavier Becerra said in a statement announcing the lawsuit.

The signatory states are California, Colorado, Connecticut, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Virginia and Wisconsin, and the complaint is filed in the courts of the Northern District of California.

Last week, several US organizations such as the American Civil Liberties Union (ACLU), the Sierra Club and the Coalition of Southern Border Communities, have already filed a lawsuit against Washington for the same reason.

In mid-February, the Secretary of Defense, Mark Esper, authorized to dedicate 3,800 million dollars of the budget allocated to new aircraft, ships and equipment of the National Guard so that the Department of National Security builds 285 kilometers of fenced in the border to avoid Illegal immigration

The court of the Northern District of California in which both lawsuits were filed last year issued several rulings to check an initial transfer of more than 6,000 million dollars of military funds to cover the construction of the wall that Trump had ordered.

The president of the US resorted to the declaration of an emergency on the southern border of the country due to the wave of undocumented immigrants who crossed it illegally to avoid the authority of Congress and justify the diversion of funds from the Pentagon for the construction of the wall, one of His main electoral promises.

The Government has appealed these decisions before the Court of Appeals for the Ninth Circuit, which has not yet ruled in this regard.

The Supreme Court, however, temporarily gave the green light last July to the use of such funds for the construction of the wall pending the resolution of the appeal, but without making a final decision.
