The Supreme Court will study whether the inclusion of Pablo Iglesias in the delegated commission of the Government that controls the CNI has been a crime of prevarication by the president of the Government, Pedro Sánchez, and the vice president himself. The Laócrata Party , the same whose complaint has triggered an investigation around Minister José Luis Ábalos by Delcygate , filed a complaint on Tuesday in the Supreme Court.

The complaint argues that both agreed to include Iglesias in the delegated commission despite knowing that they were breaking the law. They did so without formally naming him as a member of the commission, but allowing his assistance. The letter signed by the party leader, Sergio Cebolla , considers that both Sánchez and Iglesias committed crimes of administrative prevarication, one for adopting the decision and the other for accepting the appointment.

On February 25, the royal decree establishing the Government Delegated Committees was established, with the members and appointments of each of them. The reference to Intelligence Affairs indicated that "several" positions, "among them the second vice president," will attend. The complaint emphasizes that the royal decree repeals the one that was in force and did comply with the law that regulates the CNI, which specifically indicates who is part of the commission. The legal text says who makes up the commissions, except for Intelligence, "in which the formula 'will attend' is torturously used instead of 'will have the following composition'".

"Naming without naming" Iglesias

This demonstrates, according to the complainant party, that "they were aware of the abusive use of competencies, pretending to name without naming" Iglesias. "But they include it in a decree of appointments, which they are naming." And all this "knowing that the Law that regulates the National Intelligence Center lists in a tax and exclusive way the members that are part of said delegated commission". That rule includes a vice president, so the presence of Carmen Calvo means that the legal requirements are not met to add another vice president like Iglesias. "They knew they couldn't do it," insists the complaint.

The letter must now pass the filter of the Chamber that decides the admission to process or not of complaints against graduates. The same that still has to solve on the complaint of the same party against the minister of Transport, José Luis Ábalos. In parallel, the party has triggered a complaint in the courts of Madrid to investigate what happened in Barajas on the occasion of the passage by Spain of Venezuelan Vice President Delcy Rodríguez despite having banned the transit through the European Union .
