The decision stated that articles (1), (2), (3), (9), (12), (15), (23), (24), (29), (30), (33) be replaced, (35) and (52) new texts related to the scope of application, procedures for the issuance, renewal and amendment of the license granted to the marine means to sail in the waters of the Emirate, notification of the damage or the loss of the marine means, the permit of the visiting foreign marine means, the conditions for granting the license to workers on the marine means, and the validity period License, withdrawal or revocation, and training in the practice of marine activities.

This decision applies to the marine means that sail in the waters of the Emirate of Dubai located between the borders of the Emirate of Sharjah and the Emirate of Abu Dhabi and extend to the exclusive economic zone, including the internal waters of the emirate, maritime ports, marinas, canals and waterways, and on the authorities and individuals who engage in any marine activity in the Emirate of Dubai related to the use of Maritime means, their command, guidance, or work on them, or training their crew, leasing, or transport by them or any other activity related to them, provided that they are exempt from the registration and licensing provisions determined by this resolution. It is owned by the Dubai Maritime City Authority, the Armed Forces, Civil Defense, Dubai Police, registered and licensed marine means outside Dubai, who are authorized to enter the emirate, and other marine means that are determined by a decision of the Chairman of the Executive Council, provided that these marine means abide by the provisions related to security and safety and environmental requirements that apply On all maritime means.

Maritime activities in accordance with the decision include: maritime transport, inspection of maritime means, maritime safety, education and training in driving maritime facilities, training in diving and water sports, and other maritime activities that are authorized to be practiced in the emirate in accordance with the provisions of the Maritime Means Licensing Law No. (11) for the year 2010 and this decision and the decisions issued pursuant to them .. The new resolution defined the marine means as any means that passes in the waters of the Emirate of Dubai to transport passengers or goods, whether for personal, commercial, sporting or tourism purposes, whatever its type or form, as it defines the country. Aia that is transported by marine means in the Emirate of Dubai as any material or equipment or things, whether animal or agricultural or industrial or raw materials, etc., condition liquid or solid or gaseous.

Article (3) of the resolution in its new text divided the marine means that are registered and licensed from the authority of Dubai Maritime City into four categories: marine commercial means, which include: marine means for leasing, marine means operating in the ports of the Emirate of Dubai, and marine means used for construction purposes , Used for towing and piloting purposes, marine means for the carriage of passengers, and other means for the carriage of goods.

Marine excursions, which are designated for personal use, include: marine means used for excursion with an engine, including: marine means whose length is less than (12) meters, and whose length ranges from (12) meters to (24) meters, and whose length exceeds (24) meters , In addition to the marine means used for excursion without an engine, including: rowing boats, sailing boats and the like.

In accordance with the decision, marine sports facilities for the practice of water sports include: water bicycles, robots, water vehicles, hovercraft, small electric boats, and small petroleum boats. As for the traditional marine wooden means made mainly of wood, they include abras, floating wooden restaurants, and wooden boats Tourism, and the like.

The decision included procedures for issuing, renewing and amending the license, explaining the documents and documents required to complete it, and cases of notification of the damage or the loss of the marine means, as the decision obligated in Article (23) the owner of the marine means, or the captain, who is the person authorized by the authority of Dubai Maritime Authority to lead the marine way and supervise Operation and management, immediately notifying the authority of any malfunction or defect in the marine means or its devices that may affect the safety of its passengers or its suitability to sail, provided that this notification includes an indication of the nature of the malfunction or defect, its size and causes.

In the event that the marine means is destroyed for any reason, or if it is lost or stolen, the owner of the marine means or the master must immediately notify the authority of Dubai Maritime City, and return the original license to it if possible, so that the authority will conduct a technical investigation into the accident and prepare a report in this regard On the basis of which the maritime means can be removed from the registry and the license canceled, without prejudice to the rights of others.

Article (24) of the decision stipulated that the foreign marine means of visiting is permitted to sail in the emirate's water for picnic purposes or for any other purpose, whenever it was rented by a party licensed to work in Dubai, provided that this marine means obtained a permit to do so from the authority of Dubai Maritime City, The term of this permit is six months, renewable if the visiting foreign marine means will sail in the emirate's waters for picnic purposes, and six months are not renewable if the visiting foreign marine means is leased.

The decision specified the conditions for granting the license to workers on the maritime means according to the type of each vehicle, as well as determining the validity period of the license for five years, and it may be renewed for similar periods, and the Dubai Maritime Authority may issue a license to drive or work on the maritime means for a period of not more than three Months, according to the terms and requirements that are specified by a decision of the Executive Director of the Dubai Maritime City Authority in this regard, and the license issued in accordance with the provisions of this decision is considered canceled if it is not renewed within one year from the date of its expiry.

The Dubai Maritime City Authority may, in accordance with Article (33) of the decision, withdraw the license for a period not exceeding six months or revoke it, if its holder violates the provisions of the Law on Licensing Maritime Means in the Emirate of Dubai No. (11) for the year 2010 and this decision and the decisions issued pursuant thereto, and must Anyone whose license has been withdrawn or revoked immediately to the Authority.

According to the decision, no natural or legal person may train any person in any marine activity, unless he is licensed to do so from the authority of Dubai Maritime City, and the facility is authorized to practice marine activities in coordination with the competent authorities in Dubai, including the concerned authorities. By granting commercial licenses.

According to the new text of Article (52) of the Resolution, the Dubai Maritime City Authority, in coordination with the relevant government agencies in the emirate, issues the necessary decisions and instructions to implement the provisions of the law and this decision, and in particular what is related to the standards and requirements related to safety regulations for maritime means and their equipment, to ensure that The extent of their suitability for use, their conformity to environmental requirements, the regulation of mooring and harboring of marine means in the emirate's waters, and the organization of management and operation of maritime media anchors and marine sports clubs in Dubai, in addition to defining the main lines of the transportation network Marine in the emirate, specifying the paths and locations where different marine activities are permitted or prohibited, and determining the authorized speeds.

The Dubai Maritime City Authority is also competent under this Article to issue decisions and instructions related to the regulation of floating housing facilities, which are used for residence in the emirate’s waters, and include floating homes, hotels, restaurants, and marine means designated for that, provided that the decision issued in this regard specifies the conditions and procedures necessary for licensing these installations. The Authority shall have the power to propose the promulgation of any legislation necessary to implement the provisions of any international maritime treaty or agreement to which the state is a party, in connection with or related to the implementation of any of the provisions of the law and this decision.

The decision stipulated that the phrase “marine entertainment means” should be amended wherever it appears in the original decision, to be replaced by the phrase “marine excursion method”, and that the tables number (1) and (2) attached to the original decision No. (11) of 2013 concerned with determining fees should be canceled. On maritime means and the identification of violations and fines, respectively, to be replaced by the two new tables attached to this decision .. Any text in any other decision to the extent that it contradicts the provisions of this decision is repealed in the Official Gazette, and it is effective from the date of its publication.
