The Minister of Justice can breathe. The Montpellier complaint, which accused Nicole Belloubet of "illegal taking of interest" by deciding to establish an administrative court of appeal in his fief of Toulouse, rather than in the prefecture of Hérault, was dismissed.

According to a judicial source, this classification was decided on February 24 by the Applications Commission of the Court of Justice of the Republic (CJR), the only court competent to prosecute a minister for acts accomplished in the exercise of his functions. The mayor of Montpellier, Philippe Saurel, had filed this complaint on behalf of the city and denounced the minister's family and political connections with Toulouse. Nicole Belloubet was in fact assistant to the socialist mayor of the city from 2008 to 2010 and vice-president of the Midi-Pyrénées regional council from 2010 to 2013.

"The commission considered that these functions are old, that Ms. Belloubet is not a candidate in the elections in Toulouse and that the elements of the complaint do not characterize the illegal taking of interest", detailed the judicial source. Friday, Philippe Saurel, elected various left and support of President Emmanuel Macron, however announced that he wished to continue to challenge this decision in court.

Administrative cases handled in Montpellier are now subject to appeal in Marseille and those from Toulouse to Bordeaux. The new administrative court of appeal should allow them to be brought together.
