The judge has decided to prosecute the director of the Secondary Institute (IES) Murillo de Sevilla after finding evidence of a crime against the moral integrity of a teacher who died of a heart attack on January 6, 2016.

The owner of the Court of Instruction number 2 of Seville has issued an order to open an abbreviated procedure against Adolfo Ávila, after investigating the events that occurred in the center following the complaint filed by the teacher's widow for alleged harassment and harassment continued until his death from a heart failure.

The judge's decision places the defendant closer to the bench, although the magistrate will still have to assess the writings of qualification of the accusations, both of which he represents the widow and the Prosecutor's Office, who had previously requested the dismissal of the cause, as THE WORLD already reported.

According to the story made by the judge, Adolfo Ávila, then director of the IES Murillo, showed an attitude of "harassment and harassment of José Bernardo Porillo, trying to humiliate, reduce or debase him, thereby undermining, diminishing or affecting his moral integrity" . From the testimony of a dozen professors and other members of the educational community, the judge deduces that there was a "dictatorial and authoritarian" attitude on the part of the principal towards the professor, to whom he insulted, threatened and publicly despised, causing his isolation in the center and even affecting his performance as a teacher, as he interrupted his classes to address him in bad ways and prevented him from using the auditorium arbitrarily.

The judge considers, however, that there is no reasonable evidence to accuse the director of the center of prevarication or embezzlement, although the widow of José Bernardo Portillo also accused him of using the facilities for particular purposes such as holding meetings of his Neighborhood community or private tuition through a private academy for which I also worked.

Likewise, the judge has decided to dismiss the complaints against the provincial delegation of Education of the Board, despite the fact that the private prosecution demanded that an alleged dismissal of duties and lack of protection of the teacher be investigated and that he never intervened despite the fact that there were complaints by several professors and even a report from an inspector recommending the dismissal of the director of the institute for his conflicting attitude.

The widow of José Bernardo Portillo has decided to appeal the judicial order, precisely to reapply for the extension of the crimes charged to the accused and insist on the responsibility of the Education delegation.

As EL MUNDO already reported in its edition last February 8, the Office of the Prosecutor of Seville requested that the proceedings opened against the former director be filed after considering that there was no evidence of the harassment, although he did admit that there had been a conflictive relationship between the defendant and the deceased professor, which was evident in the faculty cloisters.

The Public Prosecutor's Office relied on denying the existence of harassment in a report by the Provincial Delegation of Education itself in Seville in which the administration maintained that there was no evidence of “intense psychological violence behaviors conducted repeatedly and prolonged in the time and of sufficient entity and reiteration that can be considered of labor harassment ”,“ although there has been personal conflict ”, he added.
