Kim Eriksson Sirawan was arrested in the summer of 2010 in Thailand on suspicion of possessing a laboratory for the manufacture of the amphetamine-like drug Ice.

At the Thai police's strike in his home, in addition to the drug club, around two kilos of drugs were found.

Eriksson Sirawan, who is believed to have earned around SEK 700,000 in manufacturing and sales, was arrested and sentenced in the fall of 2011 to death by a Thai court.

36 years in prison in Thailand

The death sentence was then converted to prison for 36 years and eight months. Eriksson Sirawan served variously in Thai prisons, including the infamous Bangkwang central prison in Bangkok, before being flown to Sweden a year ago to serve the rest of the prison sentence at a Swedish institution.

The Thai prison sentence was in turn converted to 18 years according to Swedish law enforcement. In addition, there is also a sentence of imprisonment for three years and three months for serious drug smuggling, which he was previously sentenced by the Swedish court.

Requested trial

Kim Eriksson Sirawan has now asked for a trial of the conviction against him in Thailand. He claims that it constitutes a violation of human rights under the European Convention.

In his application, he writes that the legal process in Thailand was unfair, that he was innocent and that he was subjected to an unlawful criminal prosecution. He believes that the investigation was manipulated, that the outcome was determined in advance and that he was not allowed to invoke relevant evidence for his innocence.

HD declines

The Supreme Court finds that the application does not relate to "any such decision that may be brought before the Supreme Court" ... and that Eriksson Sirawan's application and request to be released on trial therefore cannot be upheld.

HD rejects his request and does not grant him legal aid.

Kim Eriksson Sirawan has also appealed against the previous drug conviction in Sweden. The case is currently being processed by the Supreme Administrative Court but has not yet been decided. If Eriksson Sirawan is heard for his request, he will be released in June 2022 - unless he remains in prison until August 2024.
