The head of the Court of Instruction number 2 of Murcia has dismissed the dismissal of the proceedings against the three accused of sexually assaulting three American sisters last New Year's Eve, according to the car to which Europa Press had access.

It should be remembered that the three girls denounced the events in New Year, at the police headquarters, in which it was stated that they were sexually assaulted in two different houses, in Murcia's capital. Specifically, one of them went to his home in the company of one of the arrested; while the other two went to the detainees' house.

However, the three American sisters allegedly sexually assaulted last New Year's Eve in Murcia would have incurred alleged contradictions and "inconsistencies," according to the pre-trial order to which Europa Press has had access.

The lawyer of the three Afghan defendants, Melecio Castaño, requested on January 20 the free dismissal and the file of the case to understand that "there are no rational indications that support the credibility of the very serious allegations expressed in the initial complaint and subsequent statements of the sisters. "

On the contrary, the lawyer argued that these actions showed "that the actions of the investigated were consented by the alleged 'victims', sic, of the facts, detaching the absence of any incriminating element that justifies for longer the maintenance of the judicial complaint. "

In addition, the lawyer alleged that neither the complainant nor her sisters have ratified the complaint in court, "refusing to cooperate with Justice," and said that "there are important gaps and contradictions" in their statements.

Instead, the judge rejects this request for dismissal by noting that the sisters communicated to the Police a contact email address and that the assistant of the United States Embassy called the instructor indicating that the victims had contacted them and that They wanted to collaborate with the Spanish police.

Also, remember that one of the sisters made a photographic survey of those investigated and a statement on January 4 before the Austrian authorities. Subsequently, the judge recalls that the sisters have appeared as a private accusation and expressed their willingness to ratify the complaint.

Likewise, the judge argues that the version of the complainants about the facts is "compatible" with the report of the coroner who examined them. For all these reasons, he clarifies, "at this procedural moment we cannot conclude that there are no rational indications of having perpetrated the fact that led to the initiation of the case."
