  • Q&A What is the 'parental pin'

The legal services of the Minister of Education, Isabel Celaá, have filed an appeal before the Superior Court of Justice of Murcia on Tuesday through contentious-administrative proceedings against the resolutions of the Ministry of Education and Culture of the Murcian Government, which they direct the PP and Citizens with the support of Vox.

Although he says that this controversy "is an invented problem", Celaá has also requested, "as a matter of urgency", the adoption of a precautionary measure consisting in the suspension of the instructions appealed, as reported by sources of the Department of Education .

The appeal is filed after Murcia has not responded to the request sent on January 17, asking to withdraw the instructions that allow "to inform families" at the beginning of the course of "the complementary activities of the teaching programs that are part of the curricular proposal ", and are taught by personnel outside the educational center" in order that they may express their agreement or disagreement with the participation of their minor children in said activities ".

The Murcian Government has refused to withdraw these instructions, has claimed that they have the relevant legal and inspection reports and has said that it will comply, yes, with what the courts say.

The legal arguments of Celaá to request the withdrawal of the parental veto to talks and workshops on gender identity, feminism and diversity LGTBI are that this measure "involves a violation of the fundamental right to education" contained in article 27.1 of the Constitution, In addition to that it contravenes both the basic state regulations - the educational law in its articles 121.1, 125, 128.1, 129 and 132 - and the autonomous legislation.

Specifically, the ministry argues that in the Primary and Secondary curriculum approved by the Murcian Government, complementary activities are "evaluable for academic and compulsory purposes, both for teachers and students."

In addition, he adds that only those that are carried out outside the center or require financial contributions from families are voluntary for students.
