He says he did it out of contempt for the sexual orientation of the man, and recalls that the author, "at the time of the events, was sympathetic to the ideas derived from Nazism and the so-called white supremacism ," as confirmed by his former partner, who He stated that he had swastika flags hanging in the room.

After stabbing him, and once he had died, the convict "placed a flower in his right ear and wrote on a wall, with the deceased's own blood, the expressions 'Hitler was right' and 'KKK'", referring to the acronym from the racist United States organization Ku Klux Klan .

For everything, he is convicted of a crime of murder with alevosía and cruelty, with the aggravating discrimination for sexual orientation, and the magistrate also condemns him to pay compensation of 45,000 euros to the victim's son, with whom he did not live, and another 25,000 to the sister.

The magistrate adds the mitigation of undue delay because the police investigation and the criminal procedure were paralyzed between August 2003 and May 2016, and the defendant has been in provisional prison for this cause since September 2, 2017, when he was arrested in Colombia , and was extradited to Spain on September 20, 2018.
